55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the award of court costs and attorney's fees in certain
88 actions challenging certain local laws or the failure of an officer
99 of certain political subdivisions to perform certain acts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 2, Civil Practice and Remedies
1212 Code, is amended by adding Chapter 38A to read as follows:
1313 CHAPTER 38A. AWARD OF COURT COSTS AND ATTORNEY'S FEES IN CERTAIN
1414 ACTIONS
1515 Sec. 38A.0001. APPLICABILITY. This chapter does not apply
1616 to a municipality or county with a population of less than 45,000.
1717 Sec. 38A.0002. PREEMPTION CHALLENGE AGAINST POLITICAL
1818 SUBDIVISION. If a court determines that an order, ordinance, or
1919 similar measure of a political subdivision is unenforceable because
2020 it is preempted by the state constitution or a state statute, the
2121 court shall award the person prevailing in the action challenging
2222 the order, ordinance, or measure on that basis court costs and
2323 reasonable and necessary attorney's fees to be paid by the
2424 political subdivision.
2525 Sec. 38A.0003. FAILURE OF OFFICER OF POLITICAL SUBDIVISION
2626 TO PERFORM CERTAIN ACTS. If a court determines that an officer of a
2727 political subdivision has failed to perform an act of the office
2828 required by the state constitution or a state statute, the court
2929 shall award the person prevailing in the action challenging the
3030 officer for failure to perform that act court costs and reasonable
3131 and necessary attorney's fees to be paid by the political
3232 subdivision for which the officer served at the time of the failure
3333 to perform the act.
3434 SECTION 2. This Act applies only to an action commenced on
3535 or after the effective date of this Act.
3636 SECTION 3. This Act takes effect September 1, 2021.
