| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subtitle C, Title 2, Civil Practice and Remedies |
|---|
| 12 | 12 | | Code, is amended by adding Chapter 38A to read as follows: |
|---|
| 13 | 13 | | CHAPTER 38A. AWARD OF COURT COSTS AND ATTORNEY'S FEES IN CERTAIN |

| 14 | 14 | | ACTIONS |
|---|
| 15 | 15 | | Sec. 38A.0001. APPLICABILITY. This chapter does not apply |
|---|
| 16 | 16 | | to a municipality or county with a population of less than 45,000. |
|---|
| 17 | 17 | | Sec. 38A.0002. PREEMPTION CHALLENGE AGAINST POLITICAL |
|---|
| 18 | 18 | | SUBDIVISION. If a court determines that an order, ordinance, or |
|---|
| 19 | 19 | | similar measure of a political subdivision is unenforceable because |
|---|
| 20 | 20 | | it is preempted by the state constitution or a state statute, the |
|---|
| 21 | 21 | | court shall award the person prevailing in the action challenging |
|---|
| 22 | 22 | | the order, ordinance, or measure on that basis court costs and |
|---|
| 23 | 23 | | reasonable and necessary attorney's fees to be paid by the |
|---|
| 24 | 24 | | political subdivision. |

| 25 | 25 | | Sec. 38A.0003. FAILURE OF OFFICER OF POLITICAL SUBDIVISION |

| 26 | 26 | | TO PERFORM CERTAIN ACTS. If a court determines that an officer of a |
|---|
| 27 | 27 | | political subdivision has failed to perform an act of the office |
|---|
| 28 | 28 | | required by the state constitution or a state statute, the court |
|---|
| 29 | 29 | | shall award the person prevailing in the action challenging the |
|---|
| 30 | 30 | | officer for failure to perform that act court costs and reasonable |
|---|
| 31 | 31 | | and necessary attorney's fees to be paid by the political |
|---|
| 32 | 32 | | subdivision for which the officer served at the time of the failure |
|---|
| 33 | 33 | | to perform the act. |
|---|
| 34 | 34 | | SECTION 2. This Act applies only to an action commenced on |
|---|
| 35 | 35 | | or after the effective date of this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2021. |
