115 A BILL TO BE ENTITLED
126 AN ACT
137 relating to certain regulations adopted by a governmental entity
148 restricting the use of a natural gas or propane appliance or other
159 system or component.
1610 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1711 SECTION 1. Chapter 3000, Government Code, is amended by
1812 adding Section 3000.0021 to read as follows:
1913 Sec. 3000.0021. CERTAIN REGULATIONS REGARDING RESTRICTION
20- OF NATURAL GAS OR PROPANE. (a) No governmental entity may adopt or
21- enforce an ordinance, resolution, regulation, code, order, policy,
22- or other measure that has the purpose, intent, or effect of directly
23- or indirectly banning, limiting, restricting, discriminating
24- against, or prohibiting the use of an appliance or other system or
25- component that is fueled by natural gas or propane in the
26- construction, renovation, maintenance, or alteration of a
27- residential or commercial building.
28- (b) A governmental entity may not impose any additional
29- charge or pricing difference on a development or building permit
30- applicant that discourages those constructing homes, buildings, or
31- other structural improvements from using an appliance or other
14+ OF NATURAL GAS OR PROPANE. (a) Notwithstanding any other law, a
15+ governmental entity may not adopt or enforce a rule, charter
16+ provision, ordinance, order, or other regulation that prohibits or
17+ restricts, directly or indirectly, the use of an appliance or other
3218 system or component that is fueled by natural gas or propane in the
3319 construction, renovation, maintenance, or alteration of a
3420 residential or commercial building.
21+ (b) A rule, charter provision, ordinance, order, or other
22+ regulation adopted by a governmental entity that conflicts with
23+ this section is void.
3524 SECTION 2. This Act takes effect September 1, 2021.
