| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 56.003, Transportation Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (a-1) to read as follows: |
|---|
| 12 | 12 | | (a-1) An entity responsible for the local share of qualified |
|---|
| 13 | 13 | | project costs under Subsection (a) must be: |
|---|
| 14 | 14 | | (1) a navigation district created under Section 52, |
|---|
| 15 | 15 | | Article III, or Section 59, Article XVI, Texas Constitution, and |
|---|
| 16 | 16 | | operating under Chapter 60, 61, 62, or 63, Water Code; or |
|---|
| 17 | 17 | | (2) a municipality or board of trustees under Chapter |
|---|
| 18 | 18 | | 54. |

| 19 | 19 | | SECTION 2. Section 56.001(3), Transportation Code, is |
|---|
| 20 | 20 | | repealed. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2021. |
