9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 228, Transportation Code, | |
11 | 11 | is amended by adding Section 228.060 to read as follows: | |
12 | 12 | Sec. 228.060. CESSATION OF TOLLS ON STATE HIGHWAY 99 IN | |
13 | 13 | CERTAIN COUNTIES. The department may not charge a toll, either | |
14 | 14 | directly or indirectly through an agreement with another entity, on | |
15 | 15 | a segment of State Highway 99 located in a county with a population | |
16 | 16 | of less than 75,000 if: | |
17 | 17 | (1) the county submits to the department a resolution | |
18 | 18 | adopted by the county stating that the imposition of tolls on the | |
19 | 19 | segment has created a safety hazard on another state highway | |
20 | 20 | located in the county; and | |
21 | 21 | (2) construction on or a closure of a highway or other | |
22 | 22 | public road is located within two miles of the segment. | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2021. |
