66 AN ACT
77 relating to the cessation of tolls on segments of State Highway 99
88 located in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 228, Transportation Code,
1111 is amended by adding Section 228.060 to read as follows:
1212 Sec. 228.060. CESSATION OF TOLLS ON STATE HIGHWAY 99 IN
1313 CERTAIN COUNTIES. The department may not charge a toll, either
1414 directly or indirectly through an agreement with another entity, on
1515 a segment of State Highway 99 located in a county with a population
1616 of less than 75,000 if:
1717 (1) the county submits to the department a resolution
1818 adopted by the county stating that the imposition of tolls on the
1919 segment has created a safety hazard on another state highway
2020 located in the county; and
2121 (2) construction on or a closure of a highway or other
2222 public road is located within two miles of the segment.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2021.
