66 AN ACT
77 relating to the establishment of a bundled-pricing program to
88 reduce certain health care costs in the school employees and
99 retirees group benefits programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 1575, Insurance Code, is amended by
1212 adding Subchapter L to read as follows:
1313 SUBCHAPTER L. BUNDLED-PRICING PROGRAM
1414 Sec. 1575.551. BUNDLED-PRICING PROGRAM. (a) The trustee
1515 shall develop a cost-positive bundled-pricing program for health
1616 benefit plans provided under the group program.
1717 (b) The bundled-pricing program must be designed to reduce
1818 health care costs in the group program by contracting with a health
1919 care facility, physician, or health care provider at a consolidated
2020 rate for an inpatient or outpatient surgery procedure that is a
2121 covered health care or medical service under a health benefit plan
2222 provided under the group program.
2323 (c) A consolidated rate described by Subsection (b) must
2424 include all fees related to the covered surgery procedure,
2525 including fees for a facility, physician, health care provider,
2626 laboratory, prescription drug, or pharmacy service.
2727 Sec. 1575.552. PARTICIPATION; COST-SHARING OBLIGATION.
2828 (a) An enrollee may have an inpatient or outpatient surgery
2929 procedure under the bundled-pricing program.
3030 (b) Except as provided by Subsection (c), the trustee or a
3131 health care facility, physician, or health care provider may not
3232 require an enrollee to pay a deductible, copayment, coinsurance, or
3333 other cost-sharing obligation for a covered surgery procedure
3434 provided under the bundled-pricing program.
3535 (c) The trustee may require an enrollee in the high
3636 deductible health plan established under Section 1575.158 to meet
3737 the enrollee's deductible before the plan pays for a covered
3838 surgery procedure provided under the bundled-pricing program.
3939 Sec. 1575.553. PROVIDER PARTICIPATION. (a) A health care
4040 facility, physician, or health care provider is not required to
4141 participate in the bundled-pricing program.
4242 (b) A health care facility may not coerce a facility-based
4343 provider, as defined by Section 1575.172, to participate in the
4444 bundled-pricing program or accept a lower rate for an inpatient or
4545 outpatient surgery procedure.
4646 Sec. 1575.554. PROMPT PAYMENT. The trustee shall ensure
4747 that a health care facility, physician, or health care provider
4848 that participates in the bundled-pricing program receives payment
4949 for a covered surgery procedure not later than the 30th day after
5050 the date the administrator receives a claim for the procedure that
5151 includes all information necessary for the administrator to pay the
5252 claim.
5353 Sec. 1575.555. BUNDLED-PRICING DISCLOSURE. A health care
5454 facility, physician, or health care provider that participates in
5555 the bundled-pricing program may disclose a consolidated rate for an
5656 inpatient or outpatient surgery procedure on the facility's,
5757 physician's, or provider's Internet website and marketing
5858 materials.
5959 Sec. 1575.556. PUBLICATION OF INFORMATION. The trustee
6060 shall publish information on the bundled-pricing program,
6161 including a list of participating health care facilities,
6262 physicians, and health care providers, on the Teacher Retirement
6363 System of Texas website.
6464 Sec. 1575.557. RULEMAKING. The trustee may adopt rules as
6565 necessary to implement this subchapter.
6666 SECTION 2. Chapter 1579, Insurance Code, is amended by
6767 adding Subchapter H to read as follows:
6868 SUBCHAPTER H. BUNDLED-PRICING PROGRAM
6969 Sec. 1579.351. BUNDLED-PRICING PROGRAM. (a) The trustee
7070 shall develop a cost-positive bundled-pricing program for health
7171 coverage plans provided under the program.
7272 (b) The bundled-pricing program must be designed to reduce
7373 health care costs in the program by contracting with a health care
7474 facility, physician, or health care provider at a consolidated rate
7575 for an inpatient or outpatient surgery procedure that is a covered
7676 health care or medical service under a health coverage plan
7777 provided under the program.
7878 (c) A consolidated rate described by Subsection (b) must
7979 include all fees related to the covered surgery procedure,
8080 including fees for a facility, physician, health care provider,
8181 laboratory, prescription drug, or pharmacy service.
8282 Sec. 1579.352. PARTICIPATION; COST-SHARING OBLIGATION.
8383 (a) An enrollee may have an inpatient or outpatient surgery
8484 procedure under the bundled-pricing program.
8585 (b) The trustee or a health care facility, physician, or
8686 health care provider may not require an enrollee to pay a
8787 deductible, copayment, coinsurance, or other cost-sharing
8888 obligation for a covered surgery procedure provided under the
8989 bundled-pricing program.
9090 Sec. 1579.353. PROVIDER PARTICIPATION. (a) A health care
9191 facility, physician, or health care provider is not required to
9292 participate in the bundled-pricing program.
9393 (b) A health care facility may not coerce a facility-based
9494 provider, as defined by Section 1579.110, to participate in the
9595 bundled-pricing program or accept a lower rate for an inpatient or
9696 outpatient surgery procedure.
9797 Sec. 1579.354. PROMPT PAYMENT. The trustee shall ensure

117117 SECTION 3. This Act takes effect September 1, 2021.
