| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 285.001(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) To promote the public safety, the commissioners court of |
|---|
| 13 | 13 | | a county with a population of more than 1.3 million and a county |
|---|
| 14 | 14 | | with a population of more than 700,000 that is adjacent to a county |
|---|
| 15 | 15 | | with a population of more than four million by order may regulate |
|---|
| 16 | 16 | | the following in the unincorporated area of the county if they occur |
|---|
| 17 | 17 | | on a public highway or road, in the right-of-way of a public highway |
|---|
| 18 | 18 | | or road, or in a parking lot: |
|---|
| 19 | 19 | | (1) the sale of items by a vendor of food or |
|---|
| 20 | 20 | | merchandise, including live animals; |
|---|
| 21 | 21 | | (2) the erection, maintenance, or placement of a |
|---|
| 22 | 22 | | structure by a vendor of food or merchandise, including live |
|---|
| 23 | 23 | | animals; and |
|---|
| 24 | 24 | | (3) the solicitation of money. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2021. |
