412 AN ACT
513 relating to the medical use of low-THC cannabis by patients with
614 certain medical conditions and the establishment of
715 compassionate-use institutional review boards to evaluate and
816 approve proposed research programs to study the medical use of
917 low-THC cannabis in the treatment of certain patients.
1018 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1119 SECTION 1. Chapter 487, Health and Safety Code, is amended
1220 by adding Subchapter F to read as follows:
1321 SUBCHAPTER F. COMPASSIONATE-USE RESEARCH AND REPORTING
1422 Sec. 487.251. DEFINITIONS. In this subchapter:
1523 (1) "Executive commissioner" means the executive
1624 commissioner of the Health and Human Services Commission.
1725 (2) "Institutional review board" means a
1826 compassionate-use institutional review board established under
1927 Section 487.253.
2028 Sec. 487.252. RULES. (a) Except as otherwise provided by
2129 Subsection (b), the executive commissioner shall adopt all
2230 necessary rules to implement this subchapter, including rules
2331 designating the medical conditions for which a patient may be
2432 treated with low-THC cannabis as part of an approved research
2533 program conducted under this subchapter.
2634 (b) The Texas Medical Board may adopt rules regarding the
2735 certification of a physician by an institutional review board.
2836 Sec. 487.253. COMPASSIONATE-USE INSTITUTIONAL REVIEW
2937 BOARDS. (a) One or more compassionate-use institutional review
3038 boards may be established to:
3139 (1) evaluate and approve proposed research programs to
3240 study the medical use of low-THC cannabis in treating a medical
3341 condition designated by rule of the executive commissioner under
3442 Section 487.252(a); and
3543 (2) oversee patient treatment undertaken as part of an
3644 approved research program, including the certification of treating
3745 physicians.
3846 (b) An institutional review board must be affiliated with a
3947 dispensing organization and meet one of the following conditions:
4048 (1) be affiliated with a medical school, as defined by
4149 Section 61.501, Education Code;
4250 (2) be affiliated with a hospital licensed under
4351 Chapter 241 that has at least 150 beds;
4452 (3) be accredited by the Association for the
4553 Accreditation of Human Research Protection Programs;
4654 (4) be registered by the United States Department of
4755 Health and Human Services, Office for Human Research Protections,
4856 in accordance with 21 C.F.R. Part 56; or
4957 (5) be accredited by a national accreditation
5058 organization acceptable to the Texas Medical Board.
5159 Sec. 487.254. REPORTS BY INSTITUTIONAL REVIEW BOARDS. Each
5260 institutional review board shall submit written reports that
5361 describe and assess the research findings of each approved research
5462 program to:
5563 (1) the Health and Human Services Commission, not
5664 later than October 1 of each year; and
5765 (2) the legislature, not later than October 1 of each
5866 even-numbered year.
5967 Sec. 487.255. PATIENT TREATMENT. (a) Patient treatment
6068 provided as part of an approved research program under this
6169 subchapter may be administered only by a physician certified by an
6270 institutional review board to participate in the program.
6371 (b) A patient participating in a research program under this
6472 subchapter must be a permanent resident of this state.
6573 Sec. 487.256. INFORMED CONSENT. (a) Before receiving
6674 treatment under an approved research program, each patient must
6775 sign a written informed consent form.
6876 (b) If the patient is a minor or lacks the mental capacity to
6977 provide informed consent, a parent, guardian, or conservator may
7078 provide informed consent on the patient's behalf.
7179 (c) An institutional review board overseeing a research
7280 program under this subchapter may adopt a form to be used for the
7381 informed consent required by this section.
7482 SECTION 2. Section 169.001(3), Occupations Code, is amended
7583 to read as follows:
7684 (3) "Low-THC cannabis" means the plant Cannabis sativa
7785 L., and any part of that plant or any compound, manufacture, salt,
7886 derivative, mixture, preparation, resin, or oil of that plant that
7987 contains not more than one [0.5] percent by weight of
8088 tetrahydrocannabinols.
8189 SECTION 3. Section 169.002, Occupations Code, is amended by
8290 adding Subsection (c) to read as follows:
8391 (c) A physician is qualified to prescribe low-THC cannabis
8492 for the treatment of a patient with a medical condition approved by
8593 rule of the executive commissioner of the Health and Human Services
8694 Commission for treatment in an approved research program conducted
8795 under Subchapter F, Chapter 487, Health and Safety Code, if the
8896 physician is:
8997 (1) licensed under this subtitle; and
9098 (2) certified by a compassionate-use institutional
9199 review board created under Section 487.253, Health and Safety Code,
92100 that oversees patient treatment undertaken as part of that approved
93101 research program.
94102 SECTION 4. Section 169.003, Occupations Code, is amended to
95103 read as follows:
96- Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A
97- physician described by Section 169.002 may prescribe low-THC
98- cannabis to a patient if:

105+ described by Section 169.002 may prescribe low-THC cannabis to a
106+ patient if:
99107 (1) the patient is a permanent resident of the state;
100108 (2) the physician complies with the registration
101109 requirements of Section 169.004; and
102110 (3) the physician certifies to the department that:
103111 (A) the patient is diagnosed with:
104112 (i) epilepsy;
105113 (ii) a seizure disorder;
106114 (iii) multiple sclerosis;
107115 (iv) spasticity;
108116 (v) amyotrophic lateral sclerosis;
109117 (vi) autism;
110118 (vii) [terminal] cancer; [or]
111119 (viii) an incurable neurodegenerative
112120 disease;
113121 (ix) post-traumatic stress disorder; or
114122 (x) a medical condition that is approved
115123 for a research program under Subchapter F, Chapter 487, Health and
116124 Safety Code, and for which the patient is receiving treatment under
117125 that program; and
118126 (B) the physician determines the risk of the
119127 medical use of low-THC cannabis by the patient is reasonable in
120128 light of the potential benefit for the patient.
121129 SECTION 5. Section 169.001(6), Occupations Code, is
122130 repealed.
123131 SECTION 6. (a) Not later than December 1, 2021, the
124132 executive commissioner of the Health and Human Services Commission
125133 shall adopt rules as necessary under Section 487.252, Health and
126134 Safety Code, as added by this Act.
127135 (b) Not later than December 1, 2021, the public safety
128136 director of the Department of Public Safety shall adopt or amend
129137 department rules regarding the cultivation, processing, and
130138 dispensing of low-THC cannabis by a licensed dispensing
131139 organization under Chapter 487, Health and Safety Code.
132140 SECTION 7. This Act takes effect September 1, 2021.
