| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 105.04, Alcoholic Beverage Code, as |
|---|
| 10 | 10 | | effective September 1, 2021, is amended to read as follows: |
|---|
| 11 | 11 | | Sec. 105.04. HOURS OF SALE: WINE AND MALT BEVERAGE |
|---|
| 12 | 12 | | RETAILER. The hours of sale and delivery for alcoholic beverages |
|---|
| 13 | 13 | | sold under a wine and malt beverage retailer's permit or a wine and |
|---|
| 14 | 14 | | malt beverage retailer's off-premise permit are the same as those |
|---|
| 15 | 15 | | prescribed for the sale of malt beverages under Section 105.05[, |
|---|
| 16 | 16 | | except that no sale shall be allowed between 2 a.m. and noon on |
|---|
| 17 | 17 | | Sunday]. |

| 18 | 18 | | SECTION 2. Section 105.05(b), Alcoholic Beverage Code, as |
|---|
| 19 | 19 | | effective September 1, 2021, is amended to read as follows: |
|---|
| 20 | 20 | | (b) A person may sell, offer for sale, or deliver malt |
|---|
| 21 | 21 | | beverages between 7:00 [7] a.m. and midnight on any day except |
|---|
| 22 | 22 | | Sunday. On Sunday a person may sell malt beverages between midnight |
|---|
| 23 | 23 | | and 1:00 a.m. and between noon and midnight, except that: |
|---|
| 24 | 24 | | (1) permittees or licensees authorized to sell for |
|---|
| 25 | 25 | | on-premise consumption may sell malt beverages between 10:00 a.m. |
|---|
| 26 | 26 | | and noon if the malt beverages are served to a customer during the |
|---|
| 27 | 27 | | service of food to the customer; and |
|---|
| 28 | 28 | | (2) holders of a wine and malt beverage retailer's |
|---|
| 29 | 29 | | off-premises permit may also sell beer between 10:00 a.m. and noon. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2021. |
