6 | 6 | | relating to the authority of the governor and the legislature with |
---|
7 | 7 | | respect to certain declared states of disaster. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 418.014, Government Code, is amended by |
---|
10 | 10 | | amending Subsection (c) and adding Subsection (c-1) to read as |
---|
11 | 11 | | follows: |
---|
12 | 12 | | (c) A state of disaster may not continue for more than 30 |
---|
13 | 13 | | days unless renewed by the governor, subject to Subsection (c-1). |
---|
14 | 14 | | The legislature by law may terminate a state of disaster at any |
---|
15 | 15 | | time. On termination by the legislature, the governor shall issue |
---|
16 | 16 | | an executive order ending the state of disaster. |
---|
17 | 17 | | (c-1) If the governor finds that a state of disaster |
---|
18 | 18 | | requires renewal and the legislature is not convened in regular or |
---|
19 | 19 | | special session, the governor by proclamation shall convene the |
---|
20 | 20 | | legislature in special session to respond to the state of disaster. |
---|
21 | 21 | | SECTION 2. The changes in law made by this Act apply only to |
---|
22 | 22 | | a state of disaster declared or renewed on or after the effective |
---|
23 | 23 | | date of this Act. |
---|
24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
---|
25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
---|
26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
---|
28 | 28 | | Act takes effect September 1, 2021. |
