44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the authority of the governor and the legislature with
77 respect to certain declared states of disaster.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 418.014, Government Code, is amended by
1010 amending Subsection (c) and adding Subsection (c-1) to read as
1111 follows:
1212 (c) A state of disaster may not continue for more than 30
1313 days unless renewed by the governor, subject to Subsection (c-1).
1414 The legislature by law may terminate a state of disaster at any
1515 time. On termination by the legislature, the governor shall issue
1616 an executive order ending the state of disaster.
1717 (c-1) If the governor finds that a state of disaster
1818 requires renewal and the legislature is not convened in regular or
1919 special session, the governor by proclamation shall convene the
2020 legislature in special session to respond to the state of disaster.
2121 SECTION 2. The changes in law made by this Act apply only to
2222 a state of disaster declared or renewed on or after the effective
2323 date of this Act.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2021.
