413 AN ACT
514 relating to the system by which an application for a low income
615 housing tax credit is scored.
716 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
817 SECTION 1. Section 2306.6710(b), Government Code, is
918 amended to read as follows:
1019 (b) If an application satisfies the threshold criteria, the
1120 department shall score and rank the application using a point
1221 system that:
1322 (1) prioritizes in descending order criteria
1423 regarding:
1524 (A) financial feasibility of the development
1625 based on the supporting financial data required in the application
1726 that will include a project underwriting pro forma from the
1827 permanent or construction lender;
1928 (B) quantifiable community participation with
2029 respect to the development, evaluated on the basis of a resolution
2130 concerning the development that is voted on and adopted by the
2231 following, as applicable:
2332 (i) the governing body of a municipality in
2433 which the proposed development site is to be located;
2534 (ii) subject to Subparagraph (iii), the
2635 commissioners court of a county in which the proposed development
2736 site is to be located, if the proposed site is to be located in an
2837 area of a county that is not part of a municipality; or
2938 (iii) the commissioners court of a county
3039 in which the proposed development site is to be located and the
3140 governing body of the applicable municipality, if the proposed site
3241 is to be located in the extraterritorial jurisdiction of a
3342 municipality;
3443 (C) the income levels of tenants of the
3544 development;
3645 (D) the size and quality of the units;
3746 (E) the rent levels of the units;
3847 (F) the cost of the development by square foot;
3948 (G) the services to be provided to tenants of the
4049 development;
4150 (H) whether, at the time the complete application
4251 is submitted or at any time within the two-year period preceding the
4352 date of submission, the proposed development site is located in an
4453 area declared to be a disaster under Section 418.014;
4554 (I) quantifiable community participation with
4655 respect to the development, evaluated on the basis of written
4756 statements from any neighborhood organizations on record with the
4857 state or county in which the development is to be located and whose
4958 boundaries contain the proposed development site; and
5059 (J) the level of community support for the
5160 application, evaluated on the basis of a written statement from the
5261 state representative who represents the district containing the
5362 proposed development site;
5463 (2) uses criteria imposing penalties on applicants or
5564 affiliates who have requested extensions of department deadlines
5665 relating to developments supported by housing tax credit
5766 allocations made in the application round preceding the current
5867 round or a developer or principal of the applicant that has been
5968 removed by the lender, equity provider, or limited partners for its
6069 failure to perform its obligations under the loan documents or
6170 limited partnership agreement; [and]
6271 (3) encourages applicants to provide free notary
6372 public service to the residents of the developments for which the
6473 allocation of housing tax credits is requested; and
6574 (4) for an application concerning a development that
6675 is or will be located in a county with a population of 1 million or
6776 more but less than 4 million and that is or will be located not more
6877 than two miles from a veterans hospital, veterans affairs medical
6978 center, or veterans affairs health care center, encourages
7079 applicants to provide a preference for leasing units in the
7180 development to low income veterans.
7281 SECTION 2. The change in law made by this Act applies only
7382 to an application for low income housing tax credits that is
7483 submitted to the Texas Department of Housing and Community Affairs
7584 during an application cycle that is based on the 2022 qualified
7685 allocation plan or a subsequent plan adopted by the governing board
7786 of the department. An application that is submitted during an
7887 application cycle that is based on an earlier qualified allocation
7988 plan is governed by the law in effect on the date the application
8089 cycle began, and the former law is continued in effect for that
8190 purpose.
8291 SECTION 3. This Act takes effect September 1, 2021.
