7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Subchapter A, Section 1431.002, Health and | |
9 | 9 | Safety Code, is amended by adding a Subsection to read as follows: | |
10 | 10 | "Redispense" means to prepare or compound in the course of | |
11 | 11 | professional practice, a prescription drug or device for delivery | |
12 | 12 | to an ultimate user or the user's agent under a practitioner's | |
13 | 13 | lawful order, after the prescription or drug has been originally | |
14 | 14 | dispensed, but does not include relabeling; | |
15 | 15 | SECTION 2. Subchapter B, Section 1431.021, Health and | |
16 | 16 | Safety Code, Subdivision (w) is amended to read as follows: | |
17 | 17 | (w) except as provided under Subchapter M of this chapter | |
18 | 18 | and Section 562.1085, Occupations Code, the acceptance by a person | |
19 | 19 | of an unused prescription or drug, in whole or in part, for the | |
20 | 20 | purpose of resale or redispensing, after the prescription or drug | |
21 | 21 | has been originally dispensed, or sold; | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2021. |
