68 AN ACT
79 relating to an exemption from cemetery location restrictions for a
810 funeral establishment licensed in this state.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 711.008(b), Health and Safety Code, is
1113 amended to read as follows:
1214 (b) Subsection (a) does not apply to:
1315 (1) a cemetery heretofore established and operating;
1416 (2) the establishment and use of a columbarium by an
1517 organized religious society or sect that is exempt from income
1618 taxation under Section 501(a), Internal Revenue Code of 1986, by
1719 being listed under Section 501(c)(3) of that code, as part of or
1820 attached to the principal church building owned by the society or
1921 sect;
2022 (3) the establishment and use of a columbarium by an
2123 organized religious society or sect that is exempt from income
2224 taxation under Section 501(a), Internal Revenue Code of 1986, by
2325 being listed under Section 501(c)(3) of that code, on land that:
2426 (A) is owned by the society or sect; and
2527 (B) is part of the campus on which an existing
2628 principal church building is located;
2729 (4) the establishment and use of a columbarium on the
2830 campus of a private or independent institution of higher education,
2931 as defined by Section 61.003, Education Code, that is wholly or
3032 substantially controlled, managed, owned, or supported by or
3133 otherwise affiliated with an organized religious society or sect
3234 that is exempt from income taxation under Section 501(a), Internal
3335 Revenue Code of 1986, by being listed under Section 501(c)(3) of
3436 that code, if a place of worship is located on the campus;
3537 (5) the establishment and use of a mausoleum that is:
3638 (A) constructed beneath the principal church
3739 building owned by an organized religious society or sect that:
3840 (i) is exempt from income taxation under
3941 Section 501(a), Internal Revenue Code of 1986, by being listed
4042 under Section 501(c)(3) of that code; and
4143 (ii) has recognized religious traditions
4244 and practices of interring the remains of ordained clergy in or
4345 below the principal church building; and
4446 (B) used only for the interment of the remains of
4547 ordained clergy of that organized religious society or sect;
4648 (6) the establishment and operation, if authorized in
4749 accordance with Subsection (h), of a perpetual care cemetery by an
4850 organized religious society or sect that:
4951 (A) is exempt from income taxation under Section
5052 501(a), Internal Revenue Code of 1986, by being listed under
5153 Section 501(c)(3) of that code;
5254 (B) has been in existence for at least five
5355 years;
5456 (C) has at least $500,000 in assets; and
5557 (D) establishes and operates the cemetery on land
5658 that:
5759 (i) is owned by the society or sect;
5860 (ii) together with any other land owned by
5961 the society or sect and adjacent to the land on which the cemetery
6062 is located, is not less than 10 acres; and
6163 (iii) is in a municipality with a
6264 population of at least one million that is located predominantly in
6365 a county that has a total area of less than 1,000 square miles; [or]
6466 (7) the establishment and use of a private family
6567 cemetery by an organization that is exempt from income taxation
6668 under Section 501(a), Internal Revenue Code of 1986, by being
6769 listed under Section 501(c)(3) of that code, on land that is:
6870 (A) owned by the organization; and
6971 (B) located in a county:
7072 (i) with a population of more than 125,000;
7173 and
7274 (ii) that is adjacent to a county that has a
7375 population of more than 1.5 million and in which more than 75
7476 percent of the population lives in a single municipality; or
7577 (8) a funeral establishment licensed under Chapter
7678 651, Occupations Code, that entombs only cremated remains in a
7779 columbarium on the premises of the establishment.
7880 SECTION 2. This Act takes effect September 1, 2021.
