79 AN ACT
810 relating to certificates of public convenience and necessity for
911 certain transmission projects.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. The legislature finds that:
1214 (1) this state has long been a leader in energy policy
1315 that has delivered economic, electricity, and environmental
1416 benefits to millions of electricity consumers, businesses,
1517 state-owned lands, and landowners;
1618 (2) this state continues to experience population,
1719 business, industrial, and manufacturing growth that increases the
1820 need for reliable, low-cost electricity;
1921 (3) the ERCOT electric power grid is experiencing
2022 congestion, constraint, and curtailment that are economically
2123 undesirable;
2224 (4) the ERCOT electric power grid is experiencing load
2325 growth management challenges;
2426 (5) while this state does not import large amounts of
2527 electricity, working to ensure that this state's electricity needs
2628 are met as fully as possible from in-state resources is of strategic
2729 interest to the legislature;
2830 (6) all of the electric power industry's available
2931 power generation resources, including its wind and solar
3032 generation, natural gas-fired generation, energy storage, and
3133 transmission components, can play a substantial role in this
3234 state's economic recovery;
3335 (7) this state's oil and natural gas industries
3436 continue to grow and prosper, and those industries require low-cost
3537 electricity and a reliable electric power grid to thrive; and
3638 (8) to attract new capital projects to this state,
3739 create jobs, promote substantial new economic development, ensure a
3840 reliable and stable electric power grid that is powered by in-state
3941 resources, and keep this state as a leader on energy policy in the
4042 United States, a timely and targeted expansion of this state's
4143 electric transmission system is necessary to enhance the
4244 reliability of the system.
4345 SECTION 2. Section 37.0541, Utilities Code, is amended to
4446 read as follows:
4547 Sec. 37.0541. CONSOLIDATION OF CERTAIN PROCEEDINGS. The
4648 commission shall consolidate the proceeding on an application to
4749 obtain or amend a certificate of convenience and necessity for the
4850 construction of a transmission line with the proceeding on another
4951 application to obtain or amend a certificate of convenience and
5052 necessity for the construction of a transmission line if it is
5153 apparent from the applications or a motion to intervene in either
5254 proceeding that the transmission lines that are the subject of the
5355 separate proceedings share a common point of interconnection. [This
5456 section does not apply to a proceeding on an application for a
5557 certificate of convenience and necessity for a transmission line to
5658 serve a competitive renewable energy zone as part of a plan
5759 developed by the commission under Section 39.904(g)(2).]
5860 SECTION 3. Section 37.056, Utilities Code, is amended by
5961 adding Subsections (a-1), (d-1), (d-2), and (d-3) and amending
6062 Subsection (d) to read as follows:
6163 (a-1) In this section:
6264 (1) "Interzonal" means involving more than one ERCOT
6365 load zone.
6466 (2) "Intrazonal" means involving a single ERCOT load
6567 zone.
6668 (d) The commission by rule shall establish criteria, in
6769 addition to the criteria described by Subsection (c), for granting
6870 a certificate for a transmission project that serves the ERCOT
6971 power region and[,] that is not necessary to meet state or federal
7072 reliability standards[, and that does not serve a competitive
7173 renewable energy zone].
7274 (d-1) Except as provided by Subsection (d-2), an
7375 application for a certificate described by Subsection (d) [The
7476 criteria] must include a comparison of the levelized estimated cost
7577 of the transmission project and the levelized estimated cost
7678 savings and economic benefits that may result from the
7779 [transmission] project. The commission shall include with the
7880 commission's decision to grant or deny the certificate the
7981 commission's findings on the comparison. The comparison must
8082 account for:
8183 (1) the probable improvement of service and reduction
8284 of costs for consumers that may be realized from the project;
8385 (2) an estimated value of the reduction in interzonal
8486 and intrazonal constraint and congestion costs and interzonal and
8587 intrazonal curtailment costs that may be realized from the project;
8688 (3) an estimation of reduced transmission losses that
8789 may be realized from the project;
8890 (4) an assessment of whether the project will provide
8991 improved access to ERCOT for new generation facilities and the
9092 benefits that improved access could provide to generation
9193 facilities, industrial load, and the ERCOT market;
9294 (5) an estimation of reduced future transmission
9395 investment costs that may be realized from the project;
9496 (6) an estimation of costs of projects described by
9597 Subsection (d-2) that may be avoided as a result of the project; and
9698 (7) an estimation of direct economic benefits that may
9799 be realized from the construction of the project [The commission
98100 shall include with its decision on an application for a certificate
99101 to which this subsection applies findings on the criteria].
100102 (d-2) If an application does not include a comparison
101103 described by Subsection (d-1), the commission may not grant a
102104 certificate for a project described by Subsection (d) unless the
103105 commission finds that the project is needed to support a reliable
104106 and adequate transmission network, to facilitate wholesale
105107 competition, or to minimize curtailments due to interzonal
106108 constraints and intrazonal congestion.
107109 (d-3) Not less than once per year, the independent
108110 organization certified under Section 39.151 for the ERCOT power
109111 region shall identify transmission projects that will meet
110112 commission findings under Subsection (d-2).
111113 SECTION 4. Section 39.904(k), Utilities Code, is amended to
112114 read as follows:
113115 (k) The commission and the independent organization
114116 certified for ERCOT shall study the need for increased transmission
115117 and generation capacity throughout this state and report to the
116118 legislature the results of the study and any recommendations for
117119 legislation. The report must be filed with the legislature not
118120 later than December 31 of each even-numbered year [and may be filed
119121 as a part of the report required by Subsection (j)].
120122 SECTION 5. Subchapter Z, Chapter 39, Utilities Code, is
121123 amended by adding Section 39.918 to read as follows:
122124 Sec. 39.918. CRITICAL DESIGNATION TRANSMISSION
123125 INFRASTRUCTURE PROJECTS. (a) In this section:
124126 (1) "Interzonal" means involving more than one ERCOT
125127 load zone.
126128 (2) "Intrazonal" means involving a single ERCOT load
127129 zone.
128130 (b) Not later than December 30, 2021, the independent
129131 organization certified under Section 39.151 for the ERCOT power
130132 region shall:
131133 (1) identify, in consultation with the commission,
132134 critical designation transmission infrastructure projects and the
133135 electric utilities or transmission and distribution utilities that
134136 will construct and operate the projects in a manner consistent with
135137 Section 37.056; and
136138 (2) submit a written description of each project to
137139 the commission.
138140 (c) Projects identified under Subsection (b) must
139141 facilitate a timely and targeted expansion of the electric power
140142 grid in ERCOT for the purposes of:
141143 (1) resolving existing interzonal and intrazonal
142144 transmission constraints, congestion, or curtailments, including
143145 generic transmission constraints; and
144146 (2) ensuring the future reliability of the ERCOT
145147 electric power grid.
146148 (d) To the extent practicable, projects identified under
147149 Subsection (b) should:
148150 (1) be cost-effective and designed to transmit high
149151 volumes of electricity in and across ERCOT load zones efficiently;
150152 (2) minimize the need for the acquisition of new
151153 rights-of-way by replacing aging infrastructure or following
152154 routes that align with existing rights-of-way or existing
153155 transmission infrastructure;
154156 (3) minimize interzonal constraints and intrazonal
155157 congestion during construction activities;
156158 (4) be designed to accommodate new solutions,
157159 including higher voltages, if the independent organization
158160 determines that new solutions are required; and
159161 (5) be designed to significantly reduce present or
160162 expected future interzonal constraints and intrazonal congestion.
161163 (e) The independent organization certified under Section
162164 39.151 for the ERCOT power region shall identify as a critical
163165 designation transmission infrastructure project under Subsection
164166 (b) a project addressing an interzonal constraint or intrazonal
165167 congestion in an area if:
166168 (1) the constraint or congestion has been present for
167169 three years or longer; and
168170 (2) the area has experienced constraint or congestion
169171 costs greater than or equal to $100 million per year in each of the
170172 previous three years.
171173 (f) The independent organization certified under Section
172174 39.151 for the ERCOT power region may consult with the independent
173175 organization's market participant segments and other stakeholders
174176 to identify projects under Subsection (b) that could facilitate:
175177 (1) the growth of the economy of this state; or
176178 (2) oil and gas, commercial, and industrial
177179 development that could provide substantial new tax revenue,
178180 landowner income, or new jobs in this state.
179181 (g) Not later than the 450th day after the date that the
180182 independent organization certified under Section 39.151 for the
181183 ERCOT power region submits a written description of a project to the
182184 commission under Subsection (b), the utility that will construct
183185 and operate the project shall submit to the commission an
184186 application for a certificate of public convenience and necessity
185187 for the project.
186188 (h) In considering an application for a certificate of
187189 public convenience and necessity for a project identified under
188190 Subsection (b), the commission is not required to consider the
189191 factors provided by Sections 37.056(c)(1) and (2). The commission
190192 shall consider all factors provided by Section 37.056, including
191193 Sections 37.056(c)(1) and (2), for a project not identified under
192194 Subsection (b).
193195 (i) If the commission issues a certificate of public
194196 convenience and necessity for a project identified under Subsection
195197 (b), the commission shall find that the project is used and useful
196198 to the utility in providing service for purposes of this section,
197199 prudent, and includable in the rate base, regardless of the extent
198200 of the utility's actual use of the project.
199201 (j) Transmission service that is facilitated through a
200202 project identified under Subsection (b) must be provided in a
201203 manner consistent with Subchapter A, Chapter 35.
202204 (k) This section expires September 1, 2030.
203205 SECTION 6. Sections 39.904(g), (h), (i), and (j), Utilities
204206 Code, are repealed.
205207 SECTION 7. The changes in law made by this Act apply only to
206208 a proceeding affecting a certificate of public convenience and
207209 necessity that commences on or after the effective date of this Act.
208210 A proceeding affecting a certificate of public convenience and
209211 necessity that commenced before the effective date of this Act is
210212 governed by the law in effect on the date the proceeding is
211213 commenced, and that law is continued in effect for that purpose.
212214 SECTION 8. The recovery of a transmission facility
213215 investment made by an electric utility to serve a competitive
214216 renewable energy zone is governed by the law in effect on the date
215217 the facility is placed in service, regardless of whether the
216218 facility is completed before, on, or after the effective date of
217219 this Act, and that law is continued in effect for that purpose.
218220 SECTION 9. This Act takes effect September 1, 2021.
