77 relating to recovery of medical or health care expenses in civil
88 actions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 41.0105, Civil Practice and Remedies
1111 Code, is amended to read as follows:
1212 Sec. 41.0105. EVIDENCE RELATING TO AMOUNT OF ECONOMIC
1313 DAMAGES. (a) In addition to any other limitation under law,
1414 recovery of medical or health care expenses incurred is limited to
1515 the amount actually paid or incurred by or on behalf of the
1616 claimant.
1717 (b) Subject to Subsection (a), a party in an action in which
1818 a claimant seeks recovery of medical or health care expenses may
1919 introduce evidence of the reasonableness of the amount charged for
2020 medical or health care services provided to the claimant,
2121 including:
2222 (1) the amount actually paid for the medical or health
2323 care services provided to the claimant, unless there is a formal or
2424 informal agreement that the medical or health care provider will
2525 wholly or partly refund, rebate, or remit the amount paid to the
2626 payer or another person, in which case the amount actually paid is
2727 not admissible in evidence;
2828 (2) the amount billed by the medical or health care
2929 provider for the medical or health care services provided to the
3030 claimant;
3131 (3) the amount paid, the amount that would have been
3232 paid, or the amount likely to be paid for the medical or health care
3333 services provided to the claimant by a health benefit plan,
3434 workers' compensation insurance, an employer-provided plan,
3535 Medicaid, Medicare, or another similar source available to pay for
3636 services provided to the claimant at the time the services were
3737 provided or available to pay for the services after the services
3838 were provided, as applicable;
3939 (4) the average amount typically paid or allowed by
4040 health benefit plan issuers or governmental payers at or near the
4141 time the medical or health care services were provided to the
4242 claimant to medical or health care providers who:
4343 (A) are located in the same geographic area as
4444 the medical or health care provider who provided the services to the
4545 claimant; and
4646 (B) offer the same type of medical or health care
4747 services as the services provided to the claimant; or
4848 (5) the average of the amounts actually accepted for
4949 payment in the previous 12 months by the medical or health care
5050 provider who provided medical or health care services to the
5151 claimant for the same services provided to patients other than the
5252 claimant.
5353 SECTION 2. Section 41.0105, Civil Practice and Remedies
5454 Code, as amended by this Act, applies only to an action commenced on
5555 or after the effective date of this Act. An action commenced before
5656 the effective date of this Act is governed by the law applicable to
5757 the action immediately before the effective date of this Act, and
5858 that law is continued in effect for that purpose.
5959 SECTION 3. This Act takes effect September 1, 2021.
