9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 559, Insurance Code, is | |
11 | 11 | amended by adding Section 559.104 to read as follows: | |
12 | 12 | Sec. 559.104. DISASTERS. (a) An insurer may not increase | |
13 | 13 | an insured's premium or take an action that results in an adverse | |
14 | 14 | effect based on a factor on a consumer's credit report or change in | |
15 | 15 | a consumer's credit score that occurs during: | |
16 | 16 | (1) the period that a disaster declaration under | |
17 | 17 | Chapter 418, Government Code, is in effect for the area in which the | |
18 | 18 | consumer's residence is located; or | |
19 | 19 | (2) the two-year period following the date the | |
20 | 20 | disaster declaration expires or is terminated. | |
21 | 21 | (b) An insurer is not out of compliance with any law or rule | |
22 | 22 | relating to underwriting, rating, or rate filing as a result of | |
23 | 23 | complying with this section. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
