55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain orders, proclamations, and regulations issued
88 in response to a disaster by the governor or the presiding officer
99 of the governing body of a political subdivision.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 418.012, Government Code, is amended to
1212 read as follows:
1313 Sec. 418.012. EXECUTIVE ORDERS. (a) Under this chapter,
1414 the governor may issue, amend, or rescind executive orders,
1515 proclamations, and regulations [and amend or rescind them].
1616 (b) Executive orders, proclamations, and regulations issued
1717 by the governor have the force and effect of law.
1818 (c) To the extent of any conflict, an executive order,
1919 proclamation, or regulation issued by the governor under this
2020 chapter prevails over an order, proclamation, or regulation issued
2121 by the presiding officer of the governing body of a political
2222 subdivision under this chapter.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2021.
