66 AN ACT
77 relating to an acute psychiatric bed registry to list available
88 beds for the psychiatric treatment of certain individuals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0997 to read as follows:
1212 Sec. 531.0997. ACUTE PSYCHIATRIC BED REGISTRY. (a) In this
1313 section, "inpatient mental health facility" has the meaning
1414 assigned by Section 571.003, Health and Safety Code.
1515 (b) The commission shall develop and administer an
1616 Internet-based and searchable acute psychiatric bed registry to
1717 collect, aggregate, and display information about beds at inpatient
1818 mental health facilities located in a county with a population of
1919 four million or more that are available for the inpatient
2020 psychiatric treatment of individuals.
2121 (c) For each inpatient mental health facility, the acute
2222 psychiatric bed registry must list:
2323 (1) the name and contact information of the facility;
2424 (2) the number of available beds;
2525 (3) the type of individual who may be admitted;
2626 (4) the level of security provided; and
2727 (5) any other information that may be necessary to
2828 identify appropriate beds for the inpatient psychiatric treatment
2929 of individuals.
3030 (d) The commission shall make the acute psychiatric bed
3131 registry available to law enforcement agencies, community service
3232 boards, mental health facilities, public and private residential
3333 crisis stabilization units, emergency care facilities, and
3434 emergency care providers located in a county with a population of
3535 four million or more. The commission may make the registry
3636 available to any other person the commission considers appropriate.
3737 (e) An inpatient mental health facility located in a county
3838 with a population of four million or more shall submit to the
3939 commission information for the acute psychiatric bed registry as
4040 required by the commission and review the information and confirm
4141 its accuracy to the commission at least once daily and whenever
4242 there is a change in bed availability at the facility.
4343 (f) An inpatient mental health facility located in a county
4444 with a population of four million or more shall designate an
4545 employee or employees as necessary to:
4646 (1) submit to the commission the information required
4747 under Subsection (e) and review the information as required by that
4848 subsection; and
4949 (2) serve as a contact for questions about the
5050 information submitted.
5151 (g) The commission may contract with any person the
5252 commission considers appropriate to develop and administer the
5353 acute psychiatric bed registry.
5454 (h) The commission may accept gifts, grants, or donations
5555 from any public or private source for the purpose of carrying out
5656 this section.
5757 SECTION 2. Not later than January 1, 2022, the Health and
5858 Human Services Commission shall establish the acute psychiatric bed
5959 registry required by Section 531.0997, Government Code, as added by
6060 this Act.
6161 SECTION 3. This Act takes effect September 1, 2021.
