8 | 8 | | beds for the psychiatric treatment of certain individuals. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
11 | 11 | | amended by adding Section 531.0997 to read as follows: |
---|
12 | 12 | | Sec. 531.0997. ACUTE PSYCHIATRIC BED REGISTRY. (a) In this |
---|
13 | 13 | | section, "inpatient mental health facility" has the meaning |
---|
14 | 14 | | assigned by Section 571.003, Health and Safety Code. |
---|
15 | 15 | | (b) The commission shall develop and administer an |
---|
16 | 16 | | Internet-based and searchable acute psychiatric bed registry to |
---|
17 | 17 | | collect, aggregate, and display information about beds at inpatient |
---|
18 | 18 | | mental health facilities located in a county with a population of |
---|
19 | 19 | | four million or more that are available for the inpatient |
---|
20 | 20 | | psychiatric treatment of individuals. |
---|
21 | 21 | | (c) For each inpatient mental health facility, the acute |
---|
22 | 22 | | psychiatric bed registry must list: |
---|
23 | 23 | | (1) the name and contact information of the facility; |
---|
24 | 24 | | (2) the number of available beds; |
---|
25 | 25 | | (3) the type of individual who may be admitted; |
---|
26 | 26 | | (4) the level of security provided; and |
---|
27 | 27 | | (5) any other information that may be necessary to |
---|
28 | 28 | | identify appropriate beds for the inpatient psychiatric treatment |
---|
29 | 29 | | of individuals. |
---|
30 | 30 | | (d) The commission shall make the acute psychiatric bed |
---|
31 | 31 | | registry available to law enforcement agencies, community service |
---|
32 | 32 | | boards, mental health facilities, public and private residential |
---|
33 | 33 | | crisis stabilization units, emergency care facilities, and |
---|
34 | 34 | | emergency care providers located in a county with a population of |
---|
35 | 35 | | four million or more. The commission may make the registry |
---|
36 | 36 | | available to any other person the commission considers appropriate. |
---|
37 | 37 | | (e) An inpatient mental health facility located in a county |
---|
38 | 38 | | with a population of four million or more shall submit to the |
---|
39 | 39 | | commission information for the acute psychiatric bed registry as |
---|
40 | 40 | | required by the commission and review the information and confirm |
---|
41 | 41 | | its accuracy to the commission at least once daily and whenever |
---|
42 | 42 | | there is a change in bed availability at the facility. |
---|
43 | 43 | | (f) An inpatient mental health facility located in a county |
---|
44 | 44 | | with a population of four million or more shall designate an |
---|
45 | 45 | | employee or employees as necessary to: |
---|
46 | 46 | | (1) submit to the commission the information required |
---|
47 | 47 | | under Subsection (e) and review the information as required by that |
---|
48 | 48 | | subsection; and |
---|
49 | 49 | | (2) serve as a contact for questions about the |
---|
50 | 50 | | information submitted. |
---|
51 | 51 | | (g) The commission may contract with any person the |
---|
52 | 52 | | commission considers appropriate to develop and administer the |
---|
53 | 53 | | acute psychiatric bed registry. |
---|
54 | 54 | | (h) The commission may accept gifts, grants, or donations |
---|
55 | 55 | | from any public or private source for the purpose of carrying out |
---|
56 | 56 | | this section. |
---|
57 | 57 | | SECTION 2. Not later than January 1, 2022, the Health and |
---|
58 | 58 | | Human Services Commission shall establish the acute psychiatric bed |
---|
59 | 59 | | registry required by Section 531.0997, Government Code, as added by |
---|
60 | 60 | | this Act. |
---|
61 | 61 | | SECTION 3. This Act takes effect September 1, 2021. |
