| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 502.402(a), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) This section applies only to: | |
| 13 | 13 | (1) a county that[: | |
| 14 | 14 | [(A)] borders the United Mexican States; [and | |
| 15 | 15 | [(B) has a population of more than 250,000; and] | |
| 16 | 16 | (2) a county that is part of a regional mobility | |
| 17 | 17 | authority that includes two or more counties, at least one of which | |
| 18 | 18 | borders the United Mexican States; and | |
| 19 | 19 | (3) a county that has a population of more than 1.5 | |
| 20 | 20 | million that is coterminous with a regional mobility authority. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2021. |
