| 7 | 7 | | relating to the governor's power to control the sale, dispensing, |

| 8 | 8 | | transportation, storage, and use of alcoholic beverages, |
|---|
| 9 | 9 | | ammunition, explosives, combustibles, and weapons during a |
|---|
| 10 | 10 | | declared state of disaster or state of emergency. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 433.002(b), Government Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (b) The directive may provide for: |
|---|
| 15 | 15 | | (1) control of public and private transportation in |
|---|
| 16 | 16 | | the affected area; |
|---|
| 17 | 17 | | (2) designation of specific zones in the affected area |
|---|
| 18 | 18 | | in which, if necessary, the use and occupancy of buildings and |
|---|
| 19 | 19 | | vehicles may be controlled; |
|---|
| 20 | 20 | | (3) control of the movement of persons; |
|---|
| 21 | 21 | | (4) control of places of amusement or assembly; and |
|---|
| 22 | 22 | | (5) establishment of curfews[; |
|---|
| 23 | 23 | | [(6) control of the sale, transportation, and use of |
|---|
| 24 | 24 | | alcoholic beverages, weapons, and ammunition, except as provided by |
|---|
| 25 | 25 | | Section 433.0045; and |
|---|
| 26 | 26 | | [(7) control of the storage, use, and transportation |
|---|
| 27 | 27 | | of explosives or flammable materials considered dangerous to public |
|---|
| 28 | 28 | | safety]. |

| 29 | 29 | | SECTION 2. Section 418.019, Government Code, is repealed. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2021. |
