97 relating to establishing reimbursement rates for certain
108 child-care providers participating in the subsidized child-care
119 program administered by the Texas Workforce Commission.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter G, Chapter 2308, Government Code, is
1412 amended by amending Section 2308.315 and adding Section 2308.3151
1513 to read as follows:
1614 Sec. 2308.315. REIMBURSEMENT RATES FOR CHILD-CARE
17- PROVIDERS [CHILD CARE]. Each board shall establish and implement
18- graduated reimbursement rates for child-care providers
19- participating in the commission's subsidized child-care program
20- that align the commission's age groupings with the
21- child-to-caregiver ratios and group sizes adopted by the Health and
22- Human Services Commission. The graduated rates shall provide the
23- highest reimbursement rate to child-care providers that provide
24- care to children in the age group with the lowest
25- child-to-caregiver ratio. The commission shall supply any
26- demographic data needed by the board to establish the rates.
15+ PROVIDERS [CHILD CARE]. In establishing reimbursement rates for
16+ child-care providers participating in the commission's subsidized
17+ child-care program, each board shall equalize the amount that
18+ child-care providers providing care to children in the same
19+ commission age group receive based on the maximum number of
20+ children the provider may enroll under the child-to-caregiver
21+ ratios and group sizes adopted by the Health and Human Services
22+ Commission.
2723 Sec. 2308.3151. REIMBURSEMENT RATES FOR TEXAS RISING STAR
2824 PROGRAM PROVIDERS. (a) Each board shall establish graduated
2925 reimbursement rates for child care based on the commission's Texas
3026 Rising Star Program.
3127 (b) The minimum reimbursement rate for a Texas Rising Star
3228 Program provider must be greater than the maximum rate established
3329 for a provider who is not a Texas Rising Star Program provider for
3430 the same category of care. The reimbursement rate must be:
3531 (1) at least five percent higher for a provider with a
3632 two-star rating;
3733 (2) at least seven percent higher for a provider with a
3834 three-star rating; and
3935 (3) at least nine percent higher for a provider with a
4036 four-star rating.
4137 (c) The Texas Rising Star Program rate differential
4238 established in this section shall be funded with federal child-care
4339 [child care] development funds.
44- (d) The commission shall examine and implement strategies
45- to address the increased costs a Texas Rising Star Program provider
46- with a four-star or three-star rating would incur to provide care to
47- infants and toddlers due to low child-to-caregiver ratios for
48- children in those age groups. [Notwithstanding Subsection (b), a
49- board may not reimburse a provider under the reimbursement rates
50- provided by Subsection (b) before the date any revisions to rules
51- recommended by the Texas Rising Star Program review work group
52- under Section 2308.321 are adopted by the commission.]
53- SECTION 2. Not later than December 1, 2023, each local
54- workforce development board shall establish the child-care
55- reimbursement rates required under Section 2308.315, Government
56- Code, as amended by this Act.
57- SECTION 3. This Act takes effect September 1, 2021.
40+ [(d) Notwithstanding Subsection (b), a board may not
41+ reimburse a provider under the reimbursement rates provided by
42+ Subsection (b) before the date any revisions to rules recommended
43+ by the Texas Rising Star Program review work group under Section
44+ 2308.321 are adopted by the commission.]
