55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of sex offender treatment by certain
88 physicians and psychologists.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 110.301(c), Occupations Code, is amended
1111 to read as follows:
1212 (c) This section does not apply to:
1313 (1) a physician whose treatment of a sex offender is
1414 limited to prescribing medication to the sex offender; or
1515 (2) a person who is licensed in this state to practice
1616 as a physician or psychologist and has completed:
1717 (A) at least 24 hours of training in the specific
1818 area of sex offender assessment and treatment; and
1919 (B) at least eight hours of continuing education
2020 training in the specific area of sex offender assessment and
2121 treatment during each 12-month period in which the physician or
2222 psychologist provides sex offender treatment or acts as a sex
2323 offender treatment provider.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2021.
