68 AN ACT
79 relating to the hours for public consumption of alcoholic
810 beverages.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Sections 105.06(a-1), (b), and (c), Alcoholic
1113 Beverage Code, are amended to read as follows:
1214 (a-1) For the purposes of this section, a licensed,
1315 unlicensed, [or] permitted, or unpermitted premises is a public
1416 place.
1517 (b) In a standard hours area, a person commits an offense if
1618 the person [he] consumes or possesses with intent to consume an
1719 alcoholic beverage in a public place at any time on Sunday between
1820 1:15 a.m. and 12 noon or on any other day between 12:15 a.m. and 7
1921 a.m.
2022 (c) In an extended hours area, a person commits an offense
2123 if the person [he] consumes or possesses with intent to consume an
2224 alcoholic beverage in a public place at any time on Sunday between
2325 2:15 a.m. and 12 noon and on any other day between 2:15 a.m. and 7
2426 a.m.
2527 SECTION 2. (a) Section 105.06, Alcoholic Beverage Code, as
2628 amended by this Act, applies only to an offense committed on or
2729 after the effective date of this Act. For the purposes of this
2830 section, an offense is committed before the effective date of this
2931 Act if any element of the offense occurs before that date.
3032 (b) An offense committed before the effective date of this
3133 Act is covered by the law in effect immediately before the effective
3234 date of this Act, and that law is continued in effect for that
3335 purpose.
3436 SECTION 3. This Act takes effect September 1, 2021.
