6	8		AN ACT
7	9		relating to the hours for public consumption of alcoholic
8	10		beverages.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Sections 105.06(a-1), (b), and (c), Alcoholic
11	13		Beverage Code, are amended to read as follows:
12	14		(a-1) For the purposes of this section, a licensed,
13	15		unlicensed, [or] permitted, or unpermitted premises is a public
14	16		place.
15	17		(b) In a standard hours area, a person commits an offense if
16	18		the person [he] consumes or possesses with intent to consume an
17	19		alcoholic beverage in a public place at any time on Sunday between
18	20		1:15 a.m. and 12 noon or on any other day between 12:15 a.m. and 7
19	21		a.m.
20	22		(c) In an extended hours area, a person commits an offense
21	23		if the person [he] consumes or possesses with intent to consume an
22	24		alcoholic beverage in a public place at any time on Sunday between
23	25		2:15 a.m. and 12 noon and on any other day between 2:15 a.m. and 7
24	26		a.m.
25	27		SECTION 2. (a) Section 105.06, Alcoholic Beverage Code, as
26	28		amended by this Act, applies only to an offense committed on or
27	29		after the effective date of this Act. For the purposes of this
28	30		section, an offense is committed before the effective date of this
29	31		Act if any element of the offense occurs before that date.
30	32		(b) An offense committed before the effective date of this
31	33		Act is covered by the law in effect immediately before the effective
32	34		date of this Act, and that law is continued in effect for that
33	35		purpose.
34	36		SECTION 3. This Act takes effect September 1, 2021.
