| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter Z, Chapter 552, Local Government |
|---|
| 12 | 12 | | Code, is amended by adding Section 552.915 to read as follows: |

| 13 | 13 | | Sec. 552.915. FEE FOR WATER OR SEWER SERVICE IN CERTAIN |
|---|
| 14 | 14 | | MUNICIPALITIES. (a) This section applies only to a municipality |
|---|
| 15 | 15 | | with a population of less than 150,000. |
|---|
| 16 | 16 | | (b) A municipality's authority under this section is in |
|---|
| 17 | 17 | | addition to authority granted by municipal charter. |
|---|
| 18 | 18 | | (c) A utility that provides water or sewer service and is |
|---|
| 19 | 19 | | owned, operated, or controlled by a municipality may assess a fee |
|---|
| 20 | 20 | | for water or sewer service of not more than $1 per month for |
|---|
| 21 | 21 | | transfer under Subsection (d). |
|---|
| 22 | 22 | | (d) The municipality that owns, operates, or controls the |
|---|
| 23 | 23 | | utility described by Subsection (c) may: |
|---|
| 24 | 24 | | (1) transfer revenue from the fee authorized by |
|---|
| 25 | 25 | | Subsection (c) to the general fund of the municipality; and |
|---|
| 26 | 26 | | (2) use the revenue for the purposes of an animal |
|---|
| 27 | 27 | | shelter, as defined by Section 823.001, Health and Safety Code, |
|---|
| 28 | 28 | | that is owned or operated by the municipality. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2021. |
