77 relating to the equalization of the rates of production fees
88 charged on certain wells by the Barton Springs-Edwards Aquifer
99 Conservation District; authorizing an increase in the rate of the
1010 fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 8802.1045(g), Special District Local
1313 Laws Code, is amended to read as follows:
1414 (g) This subsection applies only to a well located in the
1515 shared territory described by Section 8802.0035. Notwithstanding
1616 Subsection (b), before September 1, 2021, the district may not
1717 charge an annual production fee of more than 17 cents per thousand
1818 gallons of water authorized to be produced under a permit from a
1919 well under this subsection, if the water is permitted for any use
2020 other than agricultural use. The district may increase the annual
2121 production fee under this subsection by not more than 10 cents per
2222 thousand gallons per year beginning on September 1, 2021, for water
2323 permitted for nonagricultural purposes, until the annual
2424 production fee is equal to the maximum amount set forth in
2525 Subsection (b).
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2021.
