55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to junior college district territory annexation and
88 program approval in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.063(d), Education Code, is amended
1111 to read as follows:
1212 (d) A [Except as provided by Subsection (e), a] junior
1313 college district may not annex territory under this section if a
1414 campus of the Texas State Technical College System is located:
1515 (1) within the county in which the territory is
1616 located; and
1717 (2) outside the junior college district.
1818 SECTION 2. Section 135.04(b), Education Code, is amended to
1919 read as follows:
2020 (b) Before any program may be offered by a campus or
2121 extension center within the tax district of a public junior college
2222 that is operating a vocational and technical program, it must be
2323 established that the public junior college is not capable of
2424 offering or is unable to offer the program. After it is
2525 established that a need for the program exists and that the program
2626 is not locally available, the campus or extension center may offer
2727 the program, provided approval is secured from the coordinating
2828 board. Approval of technical-vocational programs under this
2929 section does not apply to [Brown,] McLennan, Cameron, Fort Bend,
3030 and Potter Counties [counties].
3131 SECTION 3. Section 130.063(e), Education Code, is repealed.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2021.
