| 7 | 7 | | relating to junior college district territory annexation and |

| 8 | 8 | | program approval in certain counties. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 130.063(d), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (d) A [Except as provided by Subsection (e), a] junior |
|---|
| 13 | 13 | | college district may not annex territory under this section if a |
|---|
| 14 | 14 | | campus of the Texas State Technical College System is located: |
|---|
| 15 | 15 | | (1) within the county in which the territory is |
|---|
| 16 | 16 | | located; and |
|---|
| 17 | 17 | | (2) outside the junior college district. |
|---|
| 18 | 18 | | SECTION 2. Section 135.04(b), Education Code, is amended to |
|---|
| 19 | 19 | | read as follows: |
|---|
| 20 | 20 | | (b) Before any program may be offered by a campus or |
|---|
| 21 | 21 | | extension center within the tax district of a public junior college |
|---|
| 22 | 22 | | that is operating a vocational and technical program, it must be |
|---|
| 23 | 23 | | established that the public junior college is not capable of |
|---|
| 24 | 24 | | offering or is unable to offer the program. After it is |
|---|
| 25 | 25 | | established that a need for the program exists and that the program |
|---|
| 26 | 26 | | is not locally available, the campus or extension center may offer |
|---|
| 27 | 27 | | the program, provided approval is secured from the coordinating |
|---|
| 28 | 28 | | board. Approval of technical-vocational programs under this |
|---|
| 29 | 29 | | section does not apply to [Brown,] McLennan, Cameron, Fort Bend, |
|---|
| 30 | 30 | | and Potter Counties [counties]. |
|---|
| 31 | 31 | | SECTION 3. Section 130.063(e), Education Code, is repealed. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2021. |
