77 relating to service as an election watcher.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 33.056(a), Election Code, is amended to
1010 read as follows:
1111 (a) Except as provided by Section 33.057, a watcher is
1212 entitled to observe any activity conducted at the location at which
1313 the watcher is serving. A watcher is entitled to sit or stand
1414 [conveniently] near enough to see and hear the election officers
1515 conducting the observed activity, except as otherwise prohibited by
1616 this chapter.
1717 SECTION 2. Section 33.058, Election Code, is amended to
1818 read as follows:
1919 Sec. 33.058. RESTRICTIONS ON WATCHER'S ACTIVITIES. (a)
2020 While on duty, a watcher may not:
2121 (1) converse with the presiding judge, the alternate
2222 judge, or an election clerk [officer] regarding the election,
2323 except to call attention to an irregularity or violation of law,
2424 including a procedural mistake that cannot be reversed;
2525 (2) converse with a voter; or
2626 (3) communicate in any manner with a voter regarding
2727 the election.
2828 (b) A watcher may call the attention of an election officer
2929 to any occurrence that the watcher believes to be an irregularity or
3030 violation of law, including a potentially irreversible procedural
3131 mistake, and may discuss the matter with the officer. An officer may
3232 refer the watcher to the presiding judge [officer] at any point in
3333 the discussion. In that case, the watcher may not discuss the
3434 occurrence further with the subordinate officer unless the
3535 presiding judge [officer] invites the discussion.
3636 (c) If an election clerk disagrees with a watcher concerning
3737 a matter discussed under Subsection (a)(1), the clerk may not
3838 proceed until the presiding judge provides clarifying instruction.
3939 If the presiding judge is unavailable, the alternate judge may
4040 provide clarifying instruction.
4141 SECTION 3. Section 33.061(a), Election Code, is amended to
4242 read as follows:
4343 (a) A person commits an offense if the person serves in an
4444 official capacity at a location at which the presence of watchers is
4545 authorized and knowingly prevents a watcher from seeing or hearing
4646 [observing] an activity the watcher is entitled to observe.
4747 SECTION 4. The changes in law made by this Act apply only to
4848 an offense committed on or after the effective date of this Act. An
4949 offense committed before the effective date of this Act is governed
5050 by the law in effect on the date the offense was committed, and the
5151 former law is continued in effect for that purpose. For purposes of
5252 this section, an offense was committed before the effective date of
5353 this Act if any element of the offense occurred before that date.
5454 SECTION 5. This Act takes effect September 1, 2021.
