86 AN ACT
9- relating to delivery of ballots by mail.
7+ relating to prohibiting in-person delivery of ballots by mail.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 86.006, Election Code, is amended by
12- adding Subsections (j) and (k) to read as follows:
10+ amending Subsection (a) and adding Subsection (j) to read as
11+ follows:
12+ (a) A marked ballot voted under this chapter must be
13+ returned to the early voting clerk in the official carrier
14+ envelope. The carrier envelope may be delivered in another envelope
15+ and must be transported and delivered only by:
16+ (1) mail; or
17+ (2) common or contract carrier[; or
18+ [(3) subject to Subsection (a-1), in-person delivery
19+ by the voter who voted the ballot].
1320 (j) A ballot voted under this chapter may not be counted if
1421 delivered by any means other than as provided under Subsection (a).
15- (k) A ballot voted under this chapter may not be deposited
16- in an unattended receptacle except for a mailbox or common carrier
17- receptacle.
18- SECTION 2. This Act takes effect September 1, 2021.
22+ SECTION 2. Section 86.006(a-1), Election Code, is repealed.
23+ SECTION 3. This Act takes effect September 1, 2021.
