66 AN ACT
77 relating to the expansion of eligibility for Medicaid to all
88 persons for whom federal matching money is available.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.02473 to read as follows:
1212 Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL
1313 ASSISTANCE. (a) Notwithstanding any other law, the commission
1414 shall provide medical assistance to all persons who apply for that
1515 assistance and for whom federal matching money is available.
1616 (b) The executive commissioner shall adopt rules regarding
1717 the provision of medical assistance as required by this section.
1818 SECTION 2. Section 32.02473, Human Resources Code, as added
1919 by this Act, applies only to an initial determination or
2020 recertification of eligibility of a person for medical assistance
2121 under Chapter 32, Human Resources Code, made on or after the date
2222 the section is implemented, regardless of the date the person
2323 applied for that assistance.
2424 SECTION 3. As soon as possible after the effective date of
2525 this Act, the executive commissioner of the Health and Human
2626 Services Commission shall take all necessary actions to expand
2727 eligibility for medical assistance under Chapter 32, Human
2828 Resources Code, in accordance with Section 32.02473, Human
2929 Resources Code, as added by this Act, including notifying
3030 appropriate federal agencies of that expanded eligibility. If
3131 before implementing any provision of this Act a state agency
3232 determines that any other waiver or authorization from a federal
3333 agency is necessary for implementation of that provision, the
3434 agency affected by the provision shall request the waiver or
3535 authorization and may delay implementing that provision until the
3636 waiver or authorization is granted.
3737 SECTION 4. This Act takes effect January 1, 2022, but only
3838 if the constitutional amendment proposed by the 87th Legislature,
3939 Regular Session, 2021, requiring the state to expand eligibility
4040 for Medicaid to all persons for whom federal matching money is
4141 available is approved by the voters. If that amendment is not
4242 approved by the voters, this Act has no effect.
