66 AN ACT
77 relating to protection of the electric power transmission and
88 distribution system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. ELECTROMAGNETIC FIELD LEVELS. Section 39.151,
1111 Utilities Code, is amended by adding Subsections (o) and (p) to read
1212 as follows:
1313 (o) The commission by rule shall identify and implement
1414 design standards for the electric power transmission and
1515 distribution system to limit electromagnetic field levels and
1616 protect the transmission and distribution system.
1717 (p) The commission by rule shall require the independent
1818 organization certified under this section to consider
1919 electromagnetic field levels when determining the public need for a
2020 transmission line.
2121 SECTION 2. ELECTRICAL POWER GRID RELIABILITY TASK FORCE.
2222 (a) The electrical power grid reliability task force is created.
2323 The task force shall study the likely effectiveness and costs of
2424 various measures to protect and strengthen the electric power
2525 transmission and distribution system against all hazards.
2626 (b) The task force consists of five members appointed by the
2727 lieutenant governor and five members appointed by the speaker of
2828 the house. The task force:
2929 (1) may not:
3030 (A) consist of more than 10 members; or
3131 (B) include employees of the Public Utility
3232 Commission of Texas; and
3333 (2) must include at least the following members:
3434 (A) two members of the house of representatives
3535 appointed by the speaker of the house;
3636 (B) two senators appointed by the lieutenant
3737 governor;
3838 (C) an expert on electromagnetic pulse
3939 disturbances appointed by the lieutenant governor;
4040 (D) an expert on cybersecurity appointed by the
4141 lieutenant governor;
4242 (E) an expert on terrorism appointed by the
4343 lieutenant governor;
4444 (F) an expert on geomagnetic disturbances
4545 appointed by the speaker of the house; and
4646 (G) an expert on electric power transmission and
4747 distribution system security appointed by the speaker of the house.
4848 (c) The task force shall elect a presiding officer.
4949 (d) The task force shall:
5050 (1) evaluate strategies and technologies to
5151 strengthen the transmission and distribution system, including:
5252 (A) blocking devices;
5353 (B) faraday cages; and
5454 (C) surge arrestors;
5555 (2) survey transmission and distribution utilities
5656 to:
5757 (A) determine the number of high voltage
5858 transformers in this state; and
5959 (B) evaluate the utilities' plans to improve
6060 current infrastructure;
6161 (3) research existing grid protection policies
6262 outside this state;
6363 (4) make recommendations for the implementation of
6464 strategies and technologies that will most effectively and
6565 efficiently strengthen the transmission and distribution system,
6666 including:
6767 (A) blocking devices;
6868 (B) faraday cages; and
6969 (C) surge arrestors;
7070 (5) make recommendations regarding the allocation of
7171 costs of implementation, including recommendations for which
7272 costs, if any, should be the responsibility of shareholders or
7373 ratepayers; and
7474 (6) determine the feasibility of implementing the
7575 recommended actions.
7676 (e) Not later than September 1, 2022, the task force shall
7777 prepare and submit to the governor and the legislature a report of
7878 the task force's findings and recommendations.
7979 (f) A member of the task force established under this
8080 section is not entitled to compensation. Members may be reimbursed
8181 for expenses as follows:
8282 (1) a member is entitled to reimbursement for travel
8383 and other necessary expenses as provided in the General
8484 Appropriations Act; and
8585 (2) a member appointed as a representative of a state
8686 agency is eligible for reimbursement for travel and other necessary
8787 expenses according to the applicable agency's policies.
8888 (g) The division of emergency management of the office of
8989 the governor shall provide administrative support and staff to the
9090 advisory task force established under this section.
9191 SECTION 3. EXPIRATION. The task force established under
9292 this Act is abolished and this Act expires September 1, 2023.
9393 SECTION 4. EFFECTIVE DATE. This Act takes effect September
9494 1, 2021.
