55 AN ACT
66 relating to the expansion of eligibility for Medicaid to all
77 persons for whom federal matching money is available.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act shall be known as the Healthy Business
1010 Act.
1111 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.02473 to read as follows:
1313 Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL
1414 ASSISTANCE. (a) Notwithstanding any other law, the commission
1515 shall provide medical assistance to all persons who apply for that
1616 assistance and for whom federal matching money is available.
1717 (b) The executive commissioner shall adopt rules necessary
1818 to implement this section.
1919 SECTION 3. Section 32.02473, Human Resources Code, as added
2020 by this Act, applies only to an initial determination or
2121 recertification of eligibility of a person for medical assistance
2222 under Chapter 32, Human Resources Code, made on or after the date
2323 the section is implemented, regardless of the date the person
2424 applied for that assistance.
2525 SECTION 4. As soon as possible after the effective date of
2626 this Act, the executive commissioner of the Health and Human
2727 Services Commission shall take all necessary actions to expand
2828 eligibility for medical assistance under Chapter 32, Human
2929 Resources Code, in accordance with Section 32.02473, Human
3030 Resources Code, as added by this Act, including notifying
3131 appropriate federal agencies of that expanded eligibility.
3232 SECTION 5. If before implementing any provision of this Act
3333 a state agency determines that any other waiver or authorization
3434 from a federal agency is necessary for implementation of that
3535 provision, the agency affected by the provision shall request the
3636 waiver or authorization and may delay implementing that provision
3737 until the waiver or authorization is granted.
3838 SECTION 6. This Act takes effect September 1, 2021.
