| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Article 14.01, Code of Criminal Procedure, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | Art. 14.01. OFFENSE WITHIN VIEW. [(a) A peace officer or | |
| 12 | 12 | any other person, may, without a warrant, arrest an offender when | |
| 13 | 13 | the offense is committed in his presence or within his view, if the | |
| 14 | 14 | offense is one classed as a felony or as an offense against the | |
| 15 | 15 | public peace. | |
| 16 | 16 | [(b)] A peace officer may arrest an offender without a | |
| 17 | 17 | warrant for any offense committed in the peace officer's [his] | |
| 18 | 18 | presence or within the peace officer's [his] view. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2021. |
