7 | 7 | | relating to the prosecution of certain conduct involving prohibited |

8 | 8 | | weapons; creating a criminal offense. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 46.01, Penal Code, is amended by adding |
---|
11 | 11 | | Subdivision (20) to read as follows: |
---|
12 | 12 | | (20) "Three-dimensional printer" means a device |
---|
13 | 13 | | capable of producing a three-dimensional object from a digital |
---|
14 | 14 | | model. |
---|
15 | 15 | | SECTION 2. Section 46.05, Penal Code, is amended by |
---|
16 | 16 | | amending Subsection (a) and adding Subsection (a-1) to read as |
---|
17 | 17 | | follows: |
---|
18 | 18 | | (a) A person commits an offense if the person intentionally |
---|
19 | 19 | | or knowingly possesses, manufactures, transports, repairs, or |
---|
20 | 20 | | sells: |
---|
21 | 21 | | (1) any of the following items, unless the item is |
---|
22 | 22 | | registered in the National Firearms Registration and Transfer |
---|
23 | 23 | | Record maintained by the Bureau of Alcohol, Tobacco, Firearms and |
---|
24 | 24 | | Explosives or otherwise not subject to that registration |
---|
25 | 25 | | requirement or unless the item is classified as a curio or relic by |
---|
26 | 26 | | the United States Department of Justice: |
---|
27 | 27 | | (A) an explosive weapon; |
---|
28 | 28 | | (B) a machine gun; or |
---|
29 | 29 | | (C) a short-barrel firearm; |
---|
30 | 30 | | (2) armor-piercing ammunition; |
---|
31 | 31 | | (3) a chemical dispensing device; |
---|
32 | 32 | | (4) a zip gun; |
---|
33 | 33 | | (5) a tire deflation device; |
---|
34 | 34 | | (6) a firearm silencer, unless the firearm silencer is |
---|
35 | 35 | | classified as a curio or relic by the United States Department of |
---|
36 | 36 | | Justice or the actor otherwise possesses, manufactures, |
---|
37 | 37 | | transports, repairs, or sells the firearm silencer in compliance |
---|
38 | 38 | | with federal law; [or] |
---|
39 | 39 | | (7) an improvised explosive device; or |
---|
40 | 40 | | (8) a firearm containing a component part manufactured |
---|
41 | 41 | | using a three-dimensional printer. |
---|
42 | 42 | | (a-1) A person commits an offense if the person |
---|
43 | 43 | | intentionally or knowingly: |
---|
44 | 44 | | (1) manufactures a component part for a firearm using |
---|
45 | 45 | | a three-dimensional printer; or |
---|
46 | 46 | | (2) possesses, transports, repairs, or sells a |
---|
47 | 47 | | component part described by Subdivision (1). |
---|
48 | 48 | | SECTION 3. The change in law made by this Act applies only |
---|
49 | 49 | | to an offense committed on or after the effective date of this Act. |
---|
50 | 50 | | An offense committed before the effective date of this Act is |
---|
51 | 51 | | governed by the law in effect on the date the offense was committed, |
---|
52 | 52 | | and the former law is continued in effect for that purpose. For |
---|
53 | 53 | | purposes of this section, an offense was committed before the |
---|
54 | 54 | | effective date of this Act if any element of the offense occurred |
---|
55 | 55 | | before that date. |
---|
56 | 56 | | SECTION 4. This Act takes effect September 1, 2021. |
