55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of certain conduct involving prohibited
88 weapons; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.01, Penal Code, is amended by adding
1111 Subdivision (20) to read as follows:
1212 (20) "Three-dimensional printer" means a device
1313 capable of producing a three-dimensional object from a digital
1414 model.
1515 SECTION 2. Section 46.05, Penal Code, is amended by
1616 amending Subsection (a) and adding Subsection (a-1) to read as
1717 follows:
1818 (a) A person commits an offense if the person intentionally
1919 or knowingly possesses, manufactures, transports, repairs, or
2020 sells:
2121 (1) any of the following items, unless the item is
2222 registered in the National Firearms Registration and Transfer
2323 Record maintained by the Bureau of Alcohol, Tobacco, Firearms and
2424 Explosives or otherwise not subject to that registration
2525 requirement or unless the item is classified as a curio or relic by
2626 the United States Department of Justice:
2727 (A) an explosive weapon;
2828 (B) a machine gun; or
2929 (C) a short-barrel firearm;
3030 (2) armor-piercing ammunition;
3131 (3) a chemical dispensing device;
3232 (4) a zip gun;
3333 (5) a tire deflation device;
3434 (6) a firearm silencer, unless the firearm silencer is
3535 classified as a curio or relic by the United States Department of
3636 Justice or the actor otherwise possesses, manufactures,
3737 transports, repairs, or sells the firearm silencer in compliance
3838 with federal law; [or]
3939 (7) an improvised explosive device; or
4040 (8) a firearm containing a component part manufactured
4141 using a three-dimensional printer.
4242 (a-1) A person commits an offense if the person
4343 intentionally or knowingly:
4444 (1) manufactures a component part for a firearm using
4545 a three-dimensional printer; or
4646 (2) possesses, transports, repairs, or sells a
4747 component part described by Subdivision (1).
4848 SECTION 3. The change in law made by this Act applies only
4949 to an offense committed on or after the effective date of this Act.
5050 An offense committed before the effective date of this Act is
5151 governed by the law in effect on the date the offense was committed,
5252 and the former law is continued in effect for that purpose. For
5353 purposes of this section, an offense was committed before the
5454 effective date of this Act if any element of the offense occurred
5555 before that date.
5656 SECTION 4. This Act takes effect September 1, 2021.
