55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the notice given by a property owner prohibiting a
88 handgun license holder from carrying a handgun on the property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30.06(c)(3), Penal Code, is amended to
1111 read as follows:
1212 (3) "Written communication" means:
1313 (A) a card or other document on which is written
1414 language identical to the following: "Pursuant to Section 30.06,
1515 Penal Code (trespass by license holder with a concealed handgun), a
1616 person licensed under Subchapter H, Chapter 411, Government Code
1717 (handgun licensing law), may not enter this property with a
1818 concealed handgun"; [or]
1919 (B) a card or other document on which is:
2020 (i) written language identical to the
2121 following: "Pursuant to Section 30.06, Penal Code, Concealed Carry
2222 of Handguns Prohibited"; and
2323 (ii) a pictogram that shows a handgun
2424 within a circle and a diagonal line across the handgun;
2525 (C) a sign posted on the property that:
2626 (i) includes the language described by
2727 Paragraph (A) in both English and Spanish;
2828 (ii) appears in contrasting colors with
2929 block letters at least one inch in height; and
3030 (iii) is displayed in a conspicuous manner
3131 clearly visible to the public; or
3232 (D) a sign posted on the property that:
3333 (i) includes:
3434 (a) the language described by
3535 Paragraph (B)(i) in both English and Spanish; and
3636 (b) the pictogram described by
3737 Paragraph (B)(ii);
3838 (ii) appears in contrasting colors with
3939 block letters at least one inch in height; and
4040 (iii) is displayed in a conspicuous manner
4141 clearly visible to the public.
4242 SECTION 2. Section 30.07(c)(3), Penal Code, is amended to
4343 read as follows:
4444 (3) "Written communication" means:
4545 (A) a card or other document on which is written
4646 language identical to the following: "Pursuant to Section 30.07,
4747 Penal Code (trespass by license holder with an openly carried
4848 handgun), a person licensed under Subchapter H, Chapter 411,
4949 Government Code (handgun licensing law), may not enter this
5050 property with a handgun that is carried openly"; [or]
5151 (B) a card or other document on which is:
5252 (i) written language identical to the
5353 following: "Pursuant to Section 30.07, Penal Code, Open Carry of
5454 Handguns Prohibited"; and
5555 (ii) a pictogram that shows a handgun
5656 within a circle and a diagonal line across the handgun;
5757 (C) a sign posted on the property that:
5858 (i) includes the language described by
5959 Paragraph (A) in both English and Spanish;
6060 (ii) appears in contrasting colors with
6161 block letters at least one inch in height; and
6262 (iii) is displayed in a conspicuous manner
6363 clearly visible to the public at each entrance to the property; or
6464 (D) a sign posted on the property that:
6565 (i) includes:
6666 (a) the language described by
6767 Paragraph (B)(i) in both English and Spanish; and
6868 (b) the pictogram described by
6969 Paragraph (B)(ii);
7070 (ii) appears in contrasting colors with
7171 block letters at least one inch in height; and
7272 (iii) is displayed in a conspicuous manner
7373 clearly visible to the public.
7474 SECTION 3. The change in law made by this Act applies only
7575 to an offense committed on or after the effective date of this Act.
7676 An offense committed before the effective date of this Act is
7777 governed by the law in effect on the date the offense was committed,
7878 and the former law is continued in effect for that purpose. For
7979 purposes of this section, an offense was committed before the
8080 effective date of this Act if any element of the offense occurred
8181 before that date.
8282 SECTION 4. This Act takes effect September 1, 2021.
