| 7 | 7 | | relating to the notice given by a property owner prohibiting a |

| 8 | 8 | | handgun license holder from carrying a handgun on the property. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 30.06(c)(3), Penal Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (3) "Written communication" means: |
|---|
| 13 | 13 | | (A) a card or other document on which is written |
|---|
| 14 | 14 | | language identical to the following: "Pursuant to Section 30.06, |
|---|
| 15 | 15 | | Penal Code (trespass by license holder with a concealed handgun), a |
|---|
| 16 | 16 | | person licensed under Subchapter H, Chapter 411, Government Code |
|---|
| 17 | 17 | | (handgun licensing law), may not enter this property with a |
|---|
| 18 | 18 | | concealed handgun"; [or] |
|---|
| 19 | 19 | | (B) a card or other document on which is: |
|---|
| 20 | 20 | | (i) written language identical to the |
|---|
| 21 | 21 | | following: "Pursuant to Section 30.06, Penal Code, Concealed Carry |
|---|
| 22 | 22 | | of Handguns Prohibited"; and |
|---|
| 23 | 23 | | (ii) a pictogram that shows a handgun |
|---|
| 24 | 24 | | within a circle and a diagonal line across the handgun; |
|---|
| 25 | 25 | | (C) a sign posted on the property that: |
|---|
| 26 | 26 | | (i) includes the language described by |
|---|
| 27 | 27 | | Paragraph (A) in both English and Spanish; |
|---|
| 28 | 28 | | (ii) appears in contrasting colors with |
|---|
| 29 | 29 | | block letters at least one inch in height; and |
|---|
| 30 | 30 | | (iii) is displayed in a conspicuous manner |
|---|
| 31 | 31 | | clearly visible to the public; or |
|---|
| 32 | 32 | | (D) a sign posted on the property that: |
|---|
| 33 | 33 | | (i) includes: |
|---|
| 34 | 34 | | (a) the language described by |
|---|
| 35 | 35 | | Paragraph (B)(i) in both English and Spanish; and |
|---|
| 36 | 36 | | (b) the pictogram described by |
|---|
| 37 | 37 | | Paragraph (B)(ii); |
|---|
| 38 | 38 | | (ii) appears in contrasting colors with |
|---|
| 39 | 39 | | block letters at least one inch in height; and |
|---|
| 40 | 40 | | (iii) is displayed in a conspicuous manner |

| 42 | 42 | | SECTION 2. Section 30.07(c)(3), Penal Code, is amended to |

| 53 | 53 | | following: "Pursuant to Section 30.07, Penal Code, Open Carry of |
|---|
| 54 | 54 | | Handguns Prohibited"; and |
|---|
| 55 | 55 | | (ii) a pictogram that shows a handgun |
|---|
| 56 | 56 | | within a circle and a diagonal line across the handgun; |
|---|
| 57 | 57 | | (C) a sign posted on the property that: |
|---|
| 58 | 58 | | (i) includes the language described by |
|---|
| 59 | 59 | | Paragraph (A) in both English and Spanish; |
|---|
| 60 | 60 | | (ii) appears in contrasting colors with |
|---|
| 61 | 61 | | block letters at least one inch in height; and |
|---|
| 62 | 62 | | (iii) is displayed in a conspicuous manner |
|---|
| 63 | 63 | | clearly visible to the public at each entrance to the property; or |
|---|
| 64 | 64 | | (D) a sign posted on the property that: |
|---|
| 65 | 65 | | (i) includes: |
|---|
| 66 | 66 | | (a) the language described by |
|---|
| 67 | 67 | | Paragraph (B)(i) in both English and Spanish; and |
|---|
| 68 | 68 | | (b) the pictogram described by |
|---|
| 69 | 69 | | Paragraph (B)(ii); |
|---|
| 70 | 70 | | (ii) appears in contrasting colors with |
|---|
| 71 | 71 | | block letters at least one inch in height; and |
|---|
| 72 | 72 | | (iii) is displayed in a conspicuous manner |
|---|
| 73 | 73 | | clearly visible to the public. |
|---|
| 74 | 74 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 75 | 75 | | to an offense committed on or after the effective date of this Act. |
|---|
| 76 | 76 | | An offense committed before the effective date of this Act is |
|---|
| 77 | 77 | | governed by the law in effect on the date the offense was committed, |
|---|
| 78 | 78 | | and the former law is continued in effect for that purpose. For |
|---|
| 79 | 79 | | purposes of this section, an offense was committed before the |
|---|
| 80 | 80 | | effective date of this Act if any element of the offense occurred |
|---|
| 81 | 81 | | before that date. |
|---|
| 82 | 82 | | SECTION 4. This Act takes effect September 1, 2021. |
