410 AN ACT
511 relating to the administration of apprenticeship training
612 programs.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Sections 133.001(1), (3), (4), (5), and (6),
915 Education Code, are amended to read as follows:
1016 (1) "Apprenticeship training program" means a
1117 training program that provides on-the-job training, preparatory
1218 instruction, supplementary instruction, or related instruction in
1319 a trade that has been certified as an apprenticeable
1420 [apprenticible] occupation by the Office of Apprenticeship [Bureau
1521 of Apprenticeship Training of the United States Department of
1622 Labor].
1723 (3) "Supplementary instruction" means a course of
1824 instruction for persons employed as journeymen craftsmen in
1925 apprenticeable [apprenticible] trades that is designed to provide
2026 new skills or upgrade current skills.
2127 (4) "Related instruction" means organized,
2228 off-the-job instruction in theoretical or technical subjects
2329 required for the completion of an apprenticeship program for a
2430 particular apprenticeable [apprenticible] trade.
2531 (5) "Commission" means the Texas Workforce
2632 [Employment] Commission.
2733 (6) "Office of Apprenticeship" ["Bureau"] means the
2834 Office of Apprenticeship [Bureau of Apprenticeship Training] of the
2935 United States Department of Labor.
3036 SECTION 2. Sections 133.002(c), (d), (g), and (h),
3137 Education Code, are amended to read as follows:
3238 (c) A program must be under the direction of an
3339 apprenticeship committee whose members are appointed by one or more
3440 employers of apprentices, one or more bargaining agents
3541 representing members of an apprenticeable [apprenticible] trade,
3642 or a combination of the above, and the committee shall perform the
3743 duties set forth in Section 133.003. If an apprenticeship
3844 committee is composed of representatives of one or more employers
3945 and one or more bargaining agents, the number of committee members
4046 designated by the employer or employers shall be equal to the number
4147 of committee members designated by the bargaining agent or agents.
4248 (d) Each apprentice participating in a program must be given
4349 a written apprenticeship agreement by the apprenticeship committee
4450 stating the standards and conditions of the apprentice's employment
4551 and training. The standards must conform substantially with the
4652 standards of apprenticeship for the particular trade which have
4753 been adopted by the Office of Apprenticeship [bureau].
4854 (g) An apprenticeship training program must provide
4955 adequate facilities, personnel, and resources to effectively
5056 administer the program in a manner consistent with the public's
5157 need for skilled craftsmen and the apprentices' need for marketable
5258 skills in apprenticeable [apprenticible] occupations.
5359 (h) A program must be registered with the Office of
5460 Apprenticeship [bureau] and approved by the commission.
5561 SECTION 3. Section 133.006(b), Education Code, is amended
5662 to read as follows:
5763 (b) At least annually, the [The] commission shall prepare
5864 and submit to the Texas Workforce Investment Council or to the
5965 Apprenticeship and Training Advisory Committee, as designated by
6066 the Texas Workforce Investment Council, a report that includes:
6167 (1) an apprenticeship-related instruction cost study
6268 for the most recent state fiscal year; and
6369 (2) the funding distribution for
6470 apprenticeship-related instruction programs for the state fiscal
6571 year in which the report is submitted [an update to the
6672 Apprenticeship Related Instruction Cost Study adopted by the State
6773 Board of Education on February 10, 1973, prior to each biennial
6874 session of the legislature].
6975 SECTION 4. This Act takes effect September 1, 2021.
