66 AN ACT
77 relating to withdrawals of water from the Edwards Aquifer to supply
88 a military installation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 1.33, Chapter 626, Acts of
1111 the 73rd Legislature, Regular Session, 1993, is amended to read as
1212 follows:
1313 Sec. 1.33. WELL METERING AND PERMITTING EXEMPTIONS
1414 [EXEMPTION].
1515 SECTION 2. Section 1.33, Chapter 626, Acts of the 73rd
1616 Legislature, Regular Session, 1993, is amended by adding
1717 Subsections (e), (f), and (g) to read as follows:
1818 (e) In addition to permitted withdrawals from the aquifer, a
1919 municipally owned utility owned by the City of San Antonio, without
2020 a permit, may withdraw groundwater from the aquifer if:
2121 (1) the utility uses the groundwater to supply a
2222 military installation with water for human consumption,
2323 irrigation, operations, mission support, or infrastructure
2424 maintenance; and
2525 (2) the utility and the military installation enter
2626 into a contract requiring the installation to reduce its
2727 groundwater withdrawals from the aquifer by the same amount of
2828 withdrawn water the installation receives from the utility.
2929 (f) Subsection (e) of this section does not alter the
3030 obligations of a military installation under a biological opinion
3131 issued by a federal agency.
3232 (g) The amount of water provided by a municipally owned
3333 utility to a military installation under Subsection (e) of this
3434 section may not exceed the maximum amount of water that the military
3535 installation is authorized to withdraw from the aquifer under a
3636 biological opinion issued by a federal agency.
3737 SECTION 3. This Act takes effect September 1, 2021.
