| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 141.041, Election Code, is transferred |
|---|
| 11 | 11 | | to Subchapter B, Chapter 181, Election Code, redesignated as |
|---|
| 12 | 12 | | Section 181.0311, Election Code, and amended to read as follows: |
|---|
| 13 | 13 | | Sec. 181.0311 [141.041]. FILING FEE OR PETITION REQUIRED |
|---|
| 14 | 14 | | [TO APPEAR ON BALLOT FOR GENERAL ELECTION FOR STATE AND COUNTY |

| 15 | 15 | | OFFICERS]. (a) In addition to any other requirements, [to be |
|---|
| 16 | 16 | | eligible] to be considered for nomination by convention [placed on |
|---|
| 17 | 17 | | the ballot for the general election for state and county officers], |
|---|
| 18 | 18 | | a candidate [who is nominated by convention under Chapter 181 or |
|---|
| 19 | 19 | | 182] must: |
|---|
| 20 | 20 | | (1) pay a filing fee to the secretary of state for a |
|---|
| 21 | 21 | | statewide or district office or the county judge for a county or |
|---|
| 22 | 22 | | precinct office; or |
|---|
| 23 | 23 | | (2) submit to the secretary of state for a statewide or |
|---|
| 24 | 24 | | district office or the county judge for a county or precinct office |
|---|
| 25 | 25 | | a petition in lieu of a filing fee that satisfies the requirements |
|---|
| 26 | 26 | | prescribed by Subsection (e) and Section 141.062. |
|---|
| 27 | 27 | | (b) The amount of the filing fee is the amount prescribed by |
|---|
| 28 | 28 | | Section 172.024 for a candidate for nomination for the same office |
|---|
| 29 | 29 | | in a general primary election. |
|---|
| 30 | 30 | | (c) A filing fee received by the secretary of state shall be |
|---|
| 31 | 31 | | deposited in the state treasury to the credit of the general revenue |
|---|
| 32 | 32 | | fund. |
|---|
| 33 | 33 | | (d) A filing fee received by the county judge shall be |
|---|
| 34 | 34 | | deposited in the county treasury to the credit of the county general |
|---|
| 35 | 35 | | fund. |
|---|
| 36 | 36 | | (e) The minimum number of signatures that must appear on the |
|---|
| 37 | 37 | | petition authorized by Subsection (a) is the number prescribed by |
|---|
| 38 | 38 | | Section 172.025 to appear on a petition of a candidate for |
|---|
| 39 | 39 | | nomination for the same office in a general primary election. |
|---|
| 40 | 40 | | (f) The secretary of state shall adopt rules as necessary to |
|---|
| 41 | 41 | | implement this section. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect September 1, 2021. |
