55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to filing fees for certain candidates for office in
88 primary elections.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 141.041, Election Code, is transferred
1111 to Subchapter B, Chapter 181, Election Code, redesignated as
1212 Section 181.0311, Election Code, and amended to read as follows:
1313 Sec. 181.0311 [141.041]. FILING FEE OR PETITION REQUIRED
1414 [TO APPEAR ON BALLOT FOR GENERAL ELECTION FOR STATE AND COUNTY
1515 OFFICERS]. (a) In addition to any other requirements, [to be
1616 eligible] to be considered for nomination by convention [placed on
1717 the ballot for the general election for state and county officers],
1818 a candidate [who is nominated by convention under Chapter 181 or
1919 182] must:
2020 (1) pay a filing fee to the secretary of state for a
2121 statewide or district office or the county judge for a county or
2222 precinct office; or
2323 (2) submit to the secretary of state for a statewide or
2424 district office or the county judge for a county or precinct office
2525 a petition in lieu of a filing fee that satisfies the requirements
2626 prescribed by Subsection (e) and Section 141.062.
2727 (b) The amount of the filing fee is the amount prescribed by
2828 Section 172.024 for a candidate for nomination for the same office
2929 in a general primary election.
3030 (c) A filing fee received by the secretary of state shall be
3131 deposited in the state treasury to the credit of the general revenue
3232 fund.
3333 (d) A filing fee received by the county judge shall be
3434 deposited in the county treasury to the credit of the county general
3535 fund.
3636 (e) The minimum number of signatures that must appear on the
3737 petition authorized by Subsection (a) is the number prescribed by
3838 Section 172.025 to appear on a petition of a candidate for
3939 nomination for the same office in a general primary election.
4040 (f) The secretary of state shall adopt rules as necessary to
4141 implement this section.
4242 SECTION 2. This Act takes effect September 1, 2021.
