A BILL TO BE ENTITLED
AN ACT
relating to a mineral contractor or subcontractor's lien to secure
payment related to mineral activities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 56.002, Property Code, is amended to
read as follows:
Sec. 56.002. LIEN. A mineral contractor or subcontractor
has a lien to secure payment for material, machinery, supplies,
labor, or services related to the mineral activities.
SECTION 2. The change in law made by this Act applies only
to the furnishing or hauling of material, machinery, or supplies on
or after the effective date of this Act. The furnishing or hauling
of material, machinery, or supplies before the effective date of
this Act is governed by the law as it existed immediately before the
effective date of this Act, and that law is continued in effect for
that purpose.
SECTION 3. This Act takes effect September 1, 2021.
