| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Title 6, Utilities Code, is amended by adding |
|---|
| 11 | 11 | | Chapter 302 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 302. WIND POWER FACILITY SIGNS |
|---|
| 13 | 13 | | Sec. 302.0101. DEFINITIONS. In this chapter: |
|---|
| 14 | 14 | | (1) "Commission" means the Public Utility Commission |
|---|
| 15 | 15 | | of Texas. |
|---|
| 16 | 16 | | (2) "Wind power facility" has the meaning assigned by |
|---|
| 17 | 17 | | Section 301.0001. |
|---|
| 18 | 18 | | Sec. 302.0102. POWER TO REGULATE. (a) The commission may |
|---|
| 19 | 19 | | regulate a wind power facility as necessary to carry out the |
|---|
| 20 | 20 | | commission's duties under this chapter. |
|---|
| 21 | 21 | | (b) The commission may enforce the provisions of this |
|---|
| 22 | 22 | | chapter in the manner provided by Chapter 15 for the administrative |
|---|
| 23 | 23 | | enforcement of Title 2. |
|---|
| 24 | 24 | | Sec. 302.0103. IDENTIFYING SIGNS REQUIRED FOR WIND POWER |
|---|
| 25 | 25 | | FACILITIES. An operator of a wind power facility shall post at each |
|---|
| 26 | 26 | | entrance to the facility a sign that: |
|---|
| 27 | 27 | | (1) includes: |
|---|
| 28 | 28 | | (A) the name of the facility; |
|---|
| 29 | 29 | | (B) the name of the owner of the facility; |
|---|
| 30 | 30 | | (C) the name, business address, and phone number |
|---|
| 31 | 31 | | of the operator of the facility; |
|---|
| 32 | 32 | | (D) the number of acres in the lot on which the |
|---|
| 33 | 33 | | facility is located; |
|---|
| 34 | 34 | | (E) the county in which the sign is located; and |
|---|
| 35 | 35 | | (F) emergency contact information; |
|---|
| 36 | 36 | | (2) uses contrasting colors with block letters at |
|---|
| 37 | 37 | | least one inch in height; and |
|---|
| 38 | 38 | | (3) is displayed in a conspicuous manner clearly |
|---|
| 39 | 39 | | visible to the public. |

| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2021. |
