9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 38, Education Code, is | |
11 | 11 | amended by adding Section 38.043 to read as follows: | |
12 | 12 | Sec. 38.043. CERTAIN MANDATORY DETECTION DEVICES | |
13 | 13 | PROHIBITED. (a) In this section: | |
14 | 14 | (1) "COVID-19" means the 2019 novel coronavirus | |
15 | 15 | disease. | |
16 | 16 | (2) "COVID-19 detection device" means a device worn on | |
17 | 17 | a student's body designed and used for the purpose of: | |
18 | 18 | (A) detecting the student's temperature; | |
19 | 19 | (B) detecting the presence of COVID-19 symptoms; | |
20 | 20 | or | |
21 | 21 | (C) tracing the student's contact with other | |
22 | 22 | individuals infected with COVID-19. | |
23 | 23 | (b) A school district or open-enrollment charter school may | |
24 | 24 | not require a student to use a COVID-19 detection device at any time | |
25 | 25 | during the school day or at any activity sponsored by the district | |
26 | 26 | or school. | |
27 | 27 | SECTION 2. This Act applies beginning with the 2021-2022 | |
28 | 28 | school year. | |
29 | 29 | SECTION 3. This Act takes effect immediately if it receives | |
30 | 30 | a vote of two-thirds of all the members elected to each house, as | |
31 | 31 | provided by Section 39, Article III, Texas Constitution. If this | |
32 | 32 | Act does not receive the vote necessary for immediate effect, this | |
33 | 33 | Act takes effect September 1, 2021. |
