55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of certain disease detection devices in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.043 to read as follows:
1212 Sec. 38.043. CERTAIN MANDATORY DETECTION DEVICES
1313 PROHIBITED. (a) In this section:
1414 (1) "COVID-19" means the 2019 novel coronavirus
1515 disease.
1616 (2) "COVID-19 detection device" means a device worn on
1717 a student's body designed and used for the purpose of:
1818 (A) detecting the student's temperature;
1919 (B) detecting the presence of COVID-19 symptoms;
2020 or
2121 (C) tracing the student's contact with other
2222 individuals infected with COVID-19.
2323 (b) A school district or open-enrollment charter school may
2424 not require a student to use a COVID-19 detection device at any time
2525 during the school day or at any activity sponsored by the district
2626 or school.
2727 SECTION 2. This Act applies beginning with the 2021-2022
2828 school year.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2021.
