| 7 | 7 | | relating to establishing actual progress for the purpose of |
|---|
| 8 | 8 | | determining the right to repurchase real property from a condemning |
|---|
| 9 | 9 | | entity. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 21.101(b), Property Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (b) In this section, "actual progress" means the completion |
|---|
| 14 | 14 | | of three [two] or more of the following actions: |
|---|
| 15 | 15 | | (1) the performance of a significant amount of labor |
|---|
| 16 | 16 | | to develop the property or other property acquired for the same |
|---|
| 17 | 17 | | public use project for which the property owner's property was |
|---|
| 18 | 18 | | acquired; |
|---|
| 19 | 19 | | (2) the provision of a significant amount of materials |
|---|
| 20 | 20 | | to develop the property or other property acquired for the same |
|---|
| 21 | 21 | | public use project for which the property owner's property was |
|---|
| 22 | 22 | | acquired; |
|---|
| 23 | 23 | | (3) the hiring of and performance of a significant |
|---|
| 24 | 24 | | amount of work by an architect, engineer, or surveyor to prepare a |
|---|
| 25 | 25 | | plan or plat that includes the property or other property acquired |
|---|
| 26 | 26 | | for the same public use project for which the property owner's |
|---|
| 27 | 27 | | property was acquired; |
|---|
| 28 | 28 | | (4) application for state or federal funds to develop |
|---|
| 29 | 29 | | the property or other property acquired for the same public use |
|---|
| 30 | 30 | | project for which the property owner's property was acquired; or |
|---|
| 31 | 31 | | (5) application for a state or federal permit to |
|---|
| 32 | 32 | | develop the property or other property acquired for the same public |
|---|
| 33 | 33 | | use project for which the property owner's property was acquired[; |
|---|
| 34 | 34 | | [(6) the acquisition of a tract or parcel of real |
|---|
| 35 | 35 | | property adjacent to the property for the same public use project |
|---|
| 36 | 36 | | for which the owner's property was acquired; or |
|---|
| 37 | 37 | | [(7) for a governmental entity, the adoption by a |
|---|
| 38 | 38 | | majority of the entity's governing body at a public hearing of a |
|---|
| 39 | 39 | | development plan for a public use project that indicates that the |
|---|
| 40 | 40 | | entity will not complete more than one action described by |
|---|
| 41 | 41 | | Subdivisions (1)-(6) before the 10th anniversary of the date of |
|---|
| 42 | 42 | | acquisition of the property]. |
|---|
| 43 | 43 | | SECTION 2. Section 21.101(b), Property Code, as amended by |
|---|
| 44 | 44 | | this Act, applies only to a real property interest acquired in |
|---|
| 45 | 45 | | connection with a condemnation proceeding in which the petition is |
|---|
| 46 | 46 | | filed on or after the effective date of this Act. A real property |
|---|
| 47 | 47 | | interest acquired in connection with a condemnation proceeding in |
|---|
| 48 | 48 | | which the petition is filed before the effective date of this Act is |
|---|
| 49 | 49 | | governed by the law as it existed immediately before that date, and |
|---|
| 50 | 50 | | that law is continued in effect for that purpose. |
|---|
| 51 | 51 | | SECTION 3. This Act takes effect September 1, 2021. |
