| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 49, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 49.1531 to read as follows: |
|---|
| 13 | 13 | | Sec. 49.1531. LIMITATION ON TOTAL COST. (a) |
|---|
| 14 | 14 | | Notwithstanding any other provision of this chapter, a school |
|---|
| 15 | 15 | | district that executes an agreement to purchase attendance credit |
|---|
| 16 | 16 | | in an amount sufficient to reduce the district's local revenue |
|---|
| 17 | 17 | | level to a level that is equal to or less than the level established |
|---|
| 18 | 18 | | under Section 48.257: |
|---|
| 19 | 19 | | (1) is entitled to retain maintenance and operations |
|---|
| 20 | 20 | | tax revenue sufficient to pay the district's average maintenance |
|---|
| 21 | 21 | | and operations costs per student in average daily attendance, as |
|---|
| 22 | 22 | | determined under Subsection (b) and adjusted for inflation; and |
|---|
| 23 | 23 | | (2) may not be required to pay a total amount for |
|---|
| 24 | 24 | | attendance credit that would reduce the district's retained |
|---|
| 25 | 25 | | maintenance and operations tax revenue below the amount described |
|---|
| 26 | 26 | | by Subdivision (1). |
|---|
| 27 | 27 | | (b) For purposes of Subsection (a)(1), the commissioner |
|---|
| 28 | 28 | | shall determine a school district's average maintenance and |
|---|
| 29 | 29 | | operations costs per student in average daily attendance based on |
|---|
| 30 | 30 | | the district's maintenance and operations expenditures per student |
|---|
| 31 | 31 | | in average daily attendance for the preceding three school years. |
|---|
| 32 | 32 | | The commissioner shall adjust a district's average costs to reflect |
|---|
| 33 | 33 | | inflation in a manner determined appropriate by the commissioner. |
|---|
| 34 | 34 | | (c) A determination by the commissioner under this section |
|---|
| 35 | 35 | | is final and may not be appealed. |
|---|
| 36 | 36 | | (d) The commissioner shall adopt rules necessary to |
|---|
| 37 | 37 | | implement this section. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2021. |
