55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a limitation on the amount of school property tax
88 revenue that is subject to recapture under the public school
99 finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 49, Education Code, is
1212 amended by adding Section 49.1531 to read as follows:
1313 Sec. 49.1531. LIMITATION ON TOTAL COST. (a)
1414 Notwithstanding any other provision of this chapter, a school
1515 district that executes an agreement to purchase attendance credit
1616 in an amount sufficient to reduce the district's local revenue
1717 level to a level that is equal to or less than the level established
1818 under Section 48.257:
1919 (1) is entitled to retain maintenance and operations
2020 tax revenue sufficient to pay the district's average maintenance
2121 and operations costs per student in average daily attendance, as
2222 determined under Subsection (b) and adjusted for inflation; and
2323 (2) may not be required to pay a total amount for
2424 attendance credit that would reduce the district's retained
2525 maintenance and operations tax revenue below the amount described
2626 by Subdivision (1).
2727 (b) For purposes of Subsection (a)(1), the commissioner
2828 shall determine a school district's average maintenance and
2929 operations costs per student in average daily attendance based on
3030 the district's maintenance and operations expenditures per student
3131 in average daily attendance for the preceding three school years.
3232 The commissioner shall adjust a district's average costs to reflect
3333 inflation in a manner determined appropriate by the commissioner.
3434 (c) A determination by the commissioner under this section
3535 is final and may not be appealed.
3636 (d) The commissioner shall adopt rules necessary to
3737 implement this section.
3838 SECTION 2. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2021.
