76 AN ACT
87 relating to prohibiting certain telemarketing calls by a credit
98 access business.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 304.004, Business & Commerce Code, is
1211 amended to read as follows:
1312 Sec. 304.004. INAPPLICABILITY OF CHAPTER TO CERTAIN CALLS.
1413 This chapter does not apply to a call made:
1514 (1) by a consumer:
1615 (A) as the result of a solicitation by a seller or
1716 telemarketer; or
1817 (B) in response to general media advertising by a
1918 direct mail solicitation that clearly, conspicuously, and
2019 truthfully makes all disclosures required by federal or state law;
2120 (2) in connection with:
2221 (A) an established business relationship; or
2322 (B) a business relationship that has been
2423 terminated, if the call is made before the later of:
2524 (i) the publication date of the first Texas
2625 no-call list in which the consumer's telephone number appears; or
2726 (ii) the first anniversary of the date of
2827 termination;
2928 (3) between a telemarketer and a business, other than
3029 by a facsimile solicitation, unless the business has informed the
3130 telemarketer that the business does not wish to receive a
3231 telemarketing call from the telemarketer;
3332 (4) to collect a debt; or
3433 (5) by a state licensee, other than a credit access
3534 business licensed under Subchapter G, Chapter 393, Finance Code,
3635 if:
3736 (A) the call is not made by an automated
3837 telephone dialing system;
3938 (B) the solicited transaction is not completed
4039 until a face-to-face sales presentation by the seller occurs and
4140 the consumer is not required to pay or authorize payment until after
4241 the presentation; and
4342 (C) the consumer has not informed the
4443 telemarketer that the consumer does not wish to receive a
4544 telemarketing call from the telemarketer.
4645 SECTION 2. Subchapter G, Chapter 393, Finance Code, is
4746 amended by adding Section 393.6245 to read as follows:
4847 Sec. 393.6245. TELEMARKETING. (a) Except as provided by
4948 Subsection (b), a credit access business or a representative of a
5049 credit access business may not make a telemarketing call, as
5150 defined by Section 304.002, Business & Commerce Code, to a consumer
5251 whose name and telephone number are on the Texas no-call list
5352 maintained under Subchapter B, Chapter 304, Business & Commerce
5453 Code.
5554 (b) A credit access business or a representative of the
5655 business may make a telemarketing call to a consumer described by
5756 Subsection (a) who:
5857 (1) is a party to a contract with the business if the
5958 call is made during the term of the contract; or
6059 (2) was a party to a contract with the business if the
6160 call is made before the first anniversary of the date on which the
6261 contract was terminated, unless the consumer requests that the
6362 business or representative stop calling the consumer.
6463 SECTION 3. This Act takes effect immediately if it receives
6564 a vote of two-thirds of all the members elected to each house, as
6665 provided by Section 39, Article III, Texas Constitution. If this
6766 Act does not receive the vote necessary for immediate effect, this
6867 Act takes effect September 1, 2021.
