66 AN ACT
77 relating to a state plan for responding to pandemics.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 418, Government Code, is
1010 amended by adding Section 418.0423 to read as follows:
1111 Sec. 418.0423. PANDEMIC RESPONSE PLAN. (a) In this
1212 section, "pandemic" means an emerging infectious disease threat
1313 that has been declared a pandemic by the World Health Organization.
1414 (b) The division shall prepare and keep current a pandemic
1515 response plan. The plan may include provisions for:
1616 (1) consulting infectious disease experts regarding:
1717 (A) risk assessment;
1818 (B) identification of the pathogen; and
1919 (C) key questions about the pathogen that may
2020 affect the size, scale, and design of the response;
2121 (2) preventing and minimizing injury and damage caused
2222 by a pandemic;
2323 (3) prompt and effective response to a pandemic;
2424 (4) emergency relief;
2525 (5) identifying areas and populations particularly
2626 vulnerable to the occurrence of a pandemic;
2727 (6) communicating with governmental and private
2828 entities, including entities listed in Section 418.051, to
2929 facilitate coordination and collaboration for the efficient and
3030 effective planning and execution of a pandemic response plan;
3131 (7) organizing federal, state, and local pandemic
3232 response activities;
3333 (8) assisting local officials in designing local
3434 pandemic response plans;
3535 (9) preparing and distributing to appropriate state
3636 and local officials catalogs of federal, state, and private
3737 assistance programs; and
3838 (10) other necessary matters relating to pandemics.
3939 (c) In preparing and revising the pandemic response plan,
4040 the division shall seek the assistance of:
4141 (1) any necessary federal, state, or local
4242 governmental entity;
4343 (2) medical experts specializing in infectious
4444 disease; and
4545 (3) community leaders and business, labor,
4646 agriculture, civic, and volunteer organizations.
4747 SECTION 2. This Act takes effect September 1, 2021.
