9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 821, Health and Safety Code, is amended | |
11 | 11 | by adding Subchapter E to read as follows: | |
12 | 12 | SUBCHAPTER E. TREATMENT OF ELEPHANTS | |
13 | 13 | Sec. 821.101. USE OF CERTAIN DEVICES ON ELEPHANTS | |
14 | 14 | PROHIBITED. A person may not use any device, including a bullhook, | |
15 | 15 | ankus, baseball bat, axe handle, or pitchfork, to train or control | |
16 | 16 | the behavior of an elephant in a manner that inflicts physical pain | |
17 | 17 | on the elephant. | |
18 | 18 | Sec. 821.102. CRIMINAL PENALTY. (a) A person commits an | |
19 | 19 | offense if the person violates Section 821.101. | |
20 | 20 | (b) An offense under this section is a Class A misdemeanor, | |
21 | 21 | except that the offense is a state jail felony if it is shown at the | |
22 | 22 | trial of the offense that the defendant has previously been | |
23 | 23 | convicted two or more times of an offense under this section. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
