55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to voter education for residents of certain long-term care
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 31, Election Code, is
1111 amended by adding Section 31.0125 to read as follows:
1212 Sec. 31.0125. VOTER EDUCATION PAMPHLET FOR LONG-TERM CARE
1313 FACILITY RESIDENTS. (a) In this section, "long-term care
1414 facility" means a facility licensed under Chapter 242, 247, or 252,
1515 Health and Safety Code.
1616 (b) The secretary of state shall develop a voter education
1717 pamphlet for long-term care facility residents. The pamphlet must
1818 include information on:
1919 (1) a resident's voting rights, including information
2020 contained in the notice of voters' rights publicized under Section
2121 62.0115; and
2222 (2) the voting process, including general information
2323 on common deceptive practices and disenfranchisement methods that
2424 may occur during the voting process.
2525 (c) The secretary of state shall make the voter education
2626 pamphlet available on the secretary's Internet website.
2727 SECTION 2. Subchapter A, Chapter 242, Health and Safety
2828 Code, is amended by adding Section 242.020 to read as follows:
2929 Sec. 242.020. VOTER EDUCATION FOR RESIDENTS. (a) In this
3030 section, "voter education pamphlet" means the voter education
3131 pamphlet for long-term care facility residents developed by the
3232 secretary of state under Section 31.0125, Election Code.
3333 (b) A nursing facility employee shall, not later than the
3434 30th day before the date of an election in which residents are
3535 generally eligible to vote and using information contained in the
3636 voter education pamphlet as a reference, inform each resident,
3737 verbally and in an audible and intelligible manner, of the
3838 resident's voting rights and the voting process.
3939 (c) Each nursing facility shall make copies of the voter
4040 education pamphlet available in common areas of the facility.
4141 SECTION 3. Subchapter D, Chapter 247, Health and Safety
4242 Code, is amended by adding Section 247.072 to read as follows:
4343 Sec. 247.072. VOTER EDUCATION FOR RESIDENTS. (a) In this
4444 section, "voter education pamphlet" means the voter education
4545 pamphlet for long-term care facility residents developed by the
4646 secretary of state under Section 31.0125, Election Code.
4747 (b) An assisted living facility employee shall, not later
4848 than the 30th day before the date of an election in which facility
4949 residents are generally eligible to vote and using information
5050 contained in the voter education pamphlet as a reference, inform
5151 each resident, verbally and in an audible and intelligible manner,
5252 of the resident's voting rights and the voting process.
5353 (c) Each assisted living facility shall make copies of the
5454 voter education pamphlet available in common areas of the facility.
5555 SECTION 4. Subchapter A, Chapter 252, Health and Safety
5656 Code, is amended by adding Section 252.012 to read as follows:
5757 Sec. 252.012. VOTER EDUCATION FOR RESIDENTS. (a) In this
5858 section, "voter education pamphlet" means the voter education
5959 pamphlet for long-term care facility residents developed by the
6060 secretary of state under Section 31.0125, Election Code.
6161 (b) A facility employee shall, not later than the 30th day
6262 before the date of an election in which residents are generally
6363 eligible to vote and using information contained in the voter
6464 education pamphlet as a reference, inform each resident, verbally
6565 and in an audible and intelligible manner, of the resident's voting
6666 rights and the voting process.
6767 (c) Each facility shall make copies of the voter education
6868 pamphlet available in common areas of the facility.
6969 SECTION 5. As soon as practicable after the effective date
7070 of this Act, the secretary of state shall develop the voter
7171 education pamphlet for long-term care facility residents required
7272 by Section 31.0125, Election Code, as added by this Act.
7373 SECTION 6. This Act takes effect September 1, 2021.
