55 AN ACT
66 relating to electricity pricing rules and operating procedures that
77 eliminate or compensate for market distortion caused by certain
88 federal tax credits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.159 to read as follows:
1212 Sec. 39.159. MARKET DISTORTION RESPONSE. (a) The
1313 commission and the ERCOT independent system operator shall adopt
1414 rules, operating procedures, and protocols to eliminate or
1515 compensate for any distortion in electricity pricing in the ERCOT
1616 power region caused by a federal tax credit provided under 26 U.S.C.
1717 Section 45.
1818 (b) Rules, operating procedures, and protocols adopted
1919 under this section must ensure that costs imposed on the system by
2020 the sale of electricity that is eligible for a federal tax credit
2121 provided under 26 U.S.C. Section 45, including costs of maintaining
2222 sufficient capacity to serve load at the summer peak demand caused
2323 by the loss of new investment from below-market prices, are paid by
2424 the parties that impose the costs.
2525 (c) In conjunction with adopting rules, operating
2626 procedures, and protocols under this section, the commission and
2727 the ERCOT independent system operator shall eliminate any rules,
2828 operating procedures, or protocols that attempt to adjust
2929 electricity prices to reflect the value of reserves at different
3030 reserve levels based on the probability of reserves falling below
3131 the minimum contingency level and the value of lost load.
3232 SECTION 2. This Act takes effect September 1, 2021.
