55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of deadly force in defense of a person or
88 property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 9.32(a) and (c), Penal Code, are
1111 amended to read as follows:
1212 (a) A person is justified in using deadly force against
1313 another if the actor:
1414 (1) is [if the actor would be] justified in using force
1515 against the other under Section 9.31; [and]
1616 (2) is unable to safely retreat; and
1717 (3) [when and to the degree the actor] reasonably
1818 believes the deadly force is immediately necessary:
1919 (A) to protect the actor against the other's use
2020 or attempted use of unlawful deadly force; or
2121 (B) to prevent the other's imminent commission of
2222 aggravated kidnapping, murder, sexual assault, or aggravated
2323 sexual assault[, robbery, or aggravated robbery].
2424 (c) Notwithstanding Subsection (a)(2), a [A] person who is
2525 in the person's own habitation [has a right to be present at the
2626 location where the deadly force is used], who has not provoked the
2727 person against whom the deadly force is used, and who is not engaged
2828 in criminal activity at the time the deadly force is used is not
2929 required to retreat before using deadly force as described by this
3030 section.
3131 SECTION 2. Section 9.41, Penal Code, is amended to read as
3232 follows:
3333 Sec. 9.41. PROTECTION OF ONE'S OWN PROPERTY. (a) A person
3434 in lawful possession of land, including a habitation on the land, or
3535 tangible, movable property is justified in using force against
3636 another when and to the degree the actor reasonably believes the
3737 force is immediately necessary to prevent or terminate the other's
3838 trespass on the land or unlawful interference with the property.
3939 (b) A person unlawfully dispossessed of land, including a
4040 habitation on the land, or tangible, movable property by another is
4141 justified in using force against the other when and to the degree
4242 the actor reasonably believes the force is immediately necessary to
4343 reenter the land or recover the property if the actor uses the force
4444 immediately or in fresh pursuit after the dispossession and:
4545 (1) the actor reasonably believes the other had no
4646 claim of right when he dispossessed the actor; or
4747 (2) the other accomplished the dispossession by using
4848 force, threat, or fraud against the actor.
4949 SECTION 3. Section 9.42, Penal Code, is amended to read as
5050 follows:
5151 Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
5252 justified in using deadly force against another to protect land,
5353 including a habitation on the land, or tangible, movable property
5454 if the actor:
5555 (1) is [if he would be] justified in using force
5656 against the other under Section 9.41; [and]
5757 (2) [when and to the degree he] reasonably believes
5858 the deadly force is immediately necessary:
5959 (A) to prevent the other's imminent commission of
6060 arson, burglary, robbery, aggravated robbery, theft during the
6161 nighttime, or criminal mischief during the nighttime; or
6262 (B) to prevent the other who is fleeing
6363 immediately after committing burglary, robbery, aggravated
6464 robbery, or theft during the nighttime from escaping with the
6565 property; and
6666 (3) [he] reasonably believes that:
6767 (A) the land or property cannot be protected or
6868 recovered by any other means; or
6969 (B) the use of force other than deadly force to
7070 protect or recover the land or property would expose the actor or
7171 another to a substantial risk of death or serious bodily injury.
7272 SECTION 4. Sections 9.32(b) and (d), Penal Code, are
7373 repealed.
7474 SECTION 5. The change in law made by this Act applies only
7575 to an offense committed on or after the effective date of this Act.
7676 An offense committed before the effective date of this Act is
7777 governed by the law in effect on the date the offense was committed,
7878 and the former law is continued in effect for that purpose. For
7979 purposes of this section, an offense was committed before the
8080 effective date of this Act if any element of the offense occurred
8181 before that date.
8282 SECTION 6. This Act takes effect September 1, 2021.
