8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 202, Property Code, is amended by adding | |
10 | 10 | Section 202.020 to read as follows: | |
11 | 11 | Sec. 202.020. REGULATION OF SHORT-TERM RENTALS. (a) In | |
12 | 12 | this section, "short-term rental" means a residential property that | |
13 | 13 | is rented wholly or partly for a fee for a period not longer than 30 | |
14 | 14 | consecutive days. | |
15 | 15 | (b) Notwithstanding any other law, a property owners' | |
16 | 16 | association may adopt or enforce a provision in a dedicatory | |
17 | 17 | instrument that regulates the use of property covered by the | |
18 | 18 | dedicatory instrument as a short-term rental. | |
19 | 19 | SECTION 2. Section 202.020, Property Code, as added by this | |
20 | 20 | Act, applies to a dedicatory instrument adopted before, on, or | |
21 | 21 | after the effective date of this Act. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2021. |
