| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 375.069, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 375.069. [BOARD POSITION NOT] CIVIL OFFICE OF |
|---|
| 13 | 13 | | EMOLUMENT. (a) Subject to Subsection (b), a [A] position on the |
|---|
| 14 | 14 | | board may not be construed to be a civil office of emolument for any |
|---|
| 15 | 15 | | purpose, including those purposes described by [Article XVI,] |
|---|
| 16 | 16 | | Section 40, Article XVI, [of the] Texas Constitution. |
|---|
| 17 | 17 | | (b) The board by resolution may declare that a position on |
|---|
| 18 | 18 | | the board is a civil office of emolument under Section 40, Article |
|---|
| 19 | 19 | | XVI, Texas Constitution, if the governing board of the municipality |
|---|
| 20 | 20 | | in which the district is located consents by resolution or |
|---|
| 21 | 21 | | ordinance. |

| 22 | 22 | | SECTION 2. Section 375.070, Local Government Code, is |
|---|
| 23 | 23 | | amended to read as follows: |

| 24 | 24 | | Sec. 375.070. COMPENSATION OF DIRECTORS; REIMBURSEMENT OF |
|---|
| 25 | 25 | | EXPENSES. (a) A director is not entitled to compensation for |
|---|
| 26 | 26 | | service on the board but is entitled to be reimbursed for necessary |
|---|
| 27 | 27 | | expenses incurred in carrying out the duties and responsibilities |
|---|
| 28 | 28 | | of a director. |
|---|
| 29 | 29 | | (b) Notwithstanding Subsection (a), a director whose |
|---|
| 30 | 30 | | position is made a civil office of emolument under Section |
|---|
| 31 | 31 | | 375.069(b) is entitled to receive fees of office and reimbursement |
|---|
| 32 | 32 | | of eligible expenses in the manner provided by Section 49.060, |
|---|
| 33 | 33 | | Water Code. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2021. |
