55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to fees of office payable to directors of certain
88 municipal management districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 375.069, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 375.069. [BOARD POSITION NOT] CIVIL OFFICE OF
1313 EMOLUMENT. (a) Subject to Subsection (b), a [A] position on the
1414 board may not be construed to be a civil office of emolument for any
1515 purpose, including those purposes described by [Article XVI,]
1616 Section 40, Article XVI, [of the] Texas Constitution.
1717 (b) The board by resolution may declare that a position on
1818 the board is a civil office of emolument under Section 40, Article
1919 XVI, Texas Constitution, if the governing board of the municipality
2020 in which the district is located consents by resolution or
2121 ordinance.
2222 SECTION 2. Section 375.070, Local Government Code, is
2323 amended to read as follows:
2424 Sec. 375.070. COMPENSATION OF DIRECTORS; REIMBURSEMENT OF
2525 EXPENSES. (a) A director is not entitled to compensation for
2626 service on the board but is entitled to be reimbursed for necessary
2727 expenses incurred in carrying out the duties and responsibilities
2828 of a director.
2929 (b) Notwithstanding Subsection (a), a director whose
3030 position is made a civil office of emolument under Section
3131 375.069(b) is entitled to receive fees of office and reimbursement
3232 of eligible expenses in the manner provided by Section 49.060,
3333 Water Code.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2021.
