10 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 9 | SECTION 1. Chapter 209, Property Code, is amended by adding | |
12 | 10 | Section 209.0061 to read as follows: | |
13 | - | Sec. 209.0061. ASSOCIATION POLICY; FINES. (a) A property | |
14 | - | owners' association board shall adopt an enforcement policy | |
15 | - | regarding the levying of fines by the property owners' association. | |
16 | - | The policy must include: | |
17 | - | (1) each category of restrictive covenants for which | |
18 | - | the association may assess a reasonable fine, including: | |
19 | - | (A) property maintenance and repair; | |
20 | - | (B) individual misconduct; and | |
21 | - | (C) matters affecting health and safety; | |
22 | - | (2) a schedule of fines for each category of | |
23 | - | violation; and | |
24 | - | (3) information regarding hearings described by | |
25 | - | Section 209.007. | |
26 | - | (b) The enforcement policy adopted pursuant to Subsection | |
27 | - | (a) may reserve the board's authority to levy a fine from the | |
28 | - | schedule of fines that varies on a case-by-case basis. | |
